【摘要】：內(nèi)在客觀處罰條件是犯罪構(gòu)成要件要素中的獨特類型,其通過增加行為惡性使行為達到刑法規(guī)制范圍。在主客觀一致的責任主義原則要求下,根據(jù)先行行為的性質(zhì),可以將這一特殊構(gòu)成要件的主觀方面評價為間接故意。同時通過其他責任要素的削減實現(xiàn)犯罪與刑罰的平衡。
[Abstract]:The internal objective punishment condition is the unique type in the elements of the elements of the constitution of a crime, which makes the behavior reach the scope of the criminal law regulation by increasing the malignancy of the behavior.According to the nature of the antecedent act, the subjective aspect of this special constitutive element can be evaluated as indirect intention.At the same time, through the reduction of other elements of responsibility to achieve the balance between crime and punishment.
