【摘要】：未成年人犯罪已經(jīng)成為全社會所關(guān)注的一個(gè)熱點(diǎn)問題。由于未成年人的認(rèn)知能力不足、心理脆弱等心理因素以及不良社會環(huán)境的影響,使得他們?nèi)菀鬃呱戏缸锏缆�。我國現(xiàn)有的針對未成年人犯罪的保護(hù)性處分措施對于應(yīng)對未成年人犯罪存在許多不足之處,如缺乏專門針對未成年人犯罪的社區(qū)矯正措施、法律規(guī)定欠缺操作性、法律規(guī)定流于程式化、心理矯治重視不足等問題。未成年人犯罪保安處分制度重視對未成年人的心理矯正和一般預(yù)防,其教育和預(yù)防犯罪的鮮明特征,能夠有效的預(yù)防和矯治未成年人犯罪。因此,應(yīng)當(dāng)認(rèn)真分析我國現(xiàn)行未成年人犯罪刑事司法制度和保護(hù)性處分措施的不足,借鑒國外未成年人犯罪保安處分措施的有益經(jīng)驗(yàn),將未成年人犯罪保護(hù)性處分措施納入我國刑法典中予以刑事立法化。將未成年人犯罪保護(hù)性處分措施納入刑法典予以刑事立法化,必須立足于我國法律文化傳統(tǒng)和國情,同時(shí)合理借鑒國外未成年人刑事司法領(lǐng)域的先進(jìn)理念,建立一個(gè)針對未成年人犯罪行為的保安處分體系。在未成年人刑事司法領(lǐng)域的價(jià)值取向上,弱化基于報(bào)應(yīng)論的刑罰觀,采取教育刑的觀念,重視對未成年犯罪人的心理矯正。在具體的立法模式上,可以在刑法典中設(shè)立未成年人犯罪保安處分專節(jié)。在保安處分類型的設(shè)置上,完善我國現(xiàn)有的收容教養(yǎng)、工讀學(xué)校、社會幫教等保護(hù)性處分措施,增設(shè)社會服務(wù)令、善行保證等保安處分措施。
[Abstract]:Juvenile delinquency has become a hot issue concerned by the whole society.Because of the lack of cognitive ability, psychological frailty and the influence of bad social environment, minors are easy to take the road of crime.The existing protective measures against juvenile delinquency in our country have many deficiencies in dealing with juvenile delinquency, such as the lack of community correction measures for juvenile delinquency, the lack of operability of legal provisions,Legal provisions flow in formulaic, psychological treatment of insufficient attention and other issues.The security punishment system of juvenile delinquency attaches importance to the psychological correction and general prevention of minors, whose education and distinct characteristics of crime prevention can effectively prevent and correct juvenile delinquency.Therefore, we should seriously analyze the shortcomings of the current criminal justice system and protective measures of juvenile delinquency in our country, and draw lessons from the beneficial experience of security measures of juvenile delinquency in foreign countries.The measures of protective punishment of juvenile crime should be incorporated into the criminal law of our country.To bring the protective punishment measures of juvenile crime into criminal legislation, we must base ourselves on the tradition of legal culture and the national conditions of our country, at the same time, we should draw lessons from the advanced concepts in the field of juvenile criminal justice in foreign countries.Establish a system of security measures against juvenile delinquency.In the field of juvenile criminal justice, we should weaken the view of punishment based on retribution theory, adopt the concept of educational punishment and attach importance to the psychological correction of juvenile offenders.In the specific legislative model, we can set up a special section of security measures for juvenile delinquency in the Criminal Code.In terms of setting up the types of security measures, we should perfect the existing protective measures such as rehousing and upbringing, working and studying schools, social help and education, and add social service orders, good deeds and other security measures.
