【摘要】：近幾年,大數(shù)據(jù)技術(shù)的發(fā)展可謂迅猛,其在社會(huì)生活中得到廣泛應(yīng)用,對(duì)該技術(shù)的研究和探討熱情持續(xù)升溫,但是現(xiàn)有研究大多是從信息學(xué)方向展開(kāi)的,研究的相關(guān)問(wèn)題也主要是如何采取信息技術(shù)手段來(lái)確保大數(shù)據(jù)技術(shù)中的信息安全,從法律角度進(jìn)行的研究仍然相對(duì)空白。目前我國(guó)的刑法體系仍然是傳統(tǒng)工業(yè)社會(huì)的產(chǎn)物,面對(duì)社會(huì)中出現(xiàn)的新問(wèn)題,通過(guò)對(duì)法律條文進(jìn)行司法解釋和局部調(diào)整的方式使得其能夠適當(dāng)?shù)乜朔䴗笮�。但�?互聯(lián)網(wǎng)的發(fā)展日新月異,信息安全問(wèn)題也更加復(fù)雜多變,這都使得現(xiàn)行刑法無(wú)法發(fā)揮保障信息安全的良好作用。受限于陳舊的立法理念,使得法律體系對(duì)信息安全威脅的規(guī)制力度明顯不足,不能全面有效地保護(hù)新出現(xiàn)的法益。大數(shù)據(jù)作為促進(jìn)社會(huì)變革的關(guān)鍵力量,具有廣泛的應(yīng)用和巨大的潛在價(jià)值,因此建立完善的法律體系對(duì)大數(shù)據(jù)進(jìn)行保護(hù)勢(shì)在必行。針對(duì)大數(shù)據(jù)所匯集和處理的信息進(jìn)行保護(hù),關(guān)系到個(gè)人、公司和國(guó)家的信息安全。面對(duì)這種信息技術(shù)所引發(fā)的新的安全威脅,我們需要轉(zhuǎn)變思路,構(gòu)建一個(gè)信息化社會(huì)的刑法體系來(lái)維護(hù)重要的法律利益。在大數(shù)據(jù)時(shí)代下,信息技術(shù)的發(fā)展催生了新的法律權(quán)益,這些新的法律權(quán)益既包含了巨量的原始數(shù)資源,也包含了云計(jì)算這類信息運(yùn)算資源。這種法益的增加迫使我們要建立起信息安全的整體保護(hù)思路,首先加大對(duì)周邊犯罪行為的規(guī)制,間接地加強(qiáng)對(duì)大數(shù)據(jù)犯罪的打擊力度;其次是將保護(hù)力度延伸到大數(shù)據(jù)運(yùn)算分析的過(guò)程中,從而實(shí)現(xiàn)對(duì)數(shù)據(jù)處理平臺(tái)的有效保護(hù),實(shí)現(xiàn)對(duì)孤立數(shù)據(jù)庫(kù)到海量數(shù)據(jù)安全的風(fēng)險(xiǎn)防控;最后還需要轉(zhuǎn)變保護(hù)思路,實(shí)現(xiàn)對(duì)信息安全保護(hù)的體系化,保護(hù)信息時(shí)代下的新法益。本文通過(guò)對(duì)信息技術(shù)和法律規(guī)范的分析與解釋,探究現(xiàn)有刑法體系應(yīng)對(duì)新的技術(shù)背景下的信息安全風(fēng)險(xiǎn)時(shí)表現(xiàn)出的短板,提出有關(guān)的修改建議,以期待能夠成功應(yīng)對(duì)新的信息技術(shù)帶來(lái)的安全風(fēng)險(xiǎn)。
[Abstract]:In recent years, the development of big data technology is rapid, it is widely used in social life, a study on the technology of enthusiasm continues to heat up, but most of the existing research is conducted from the direction of information science, the research of related problems is how to take the information technology means to ensure the information security of big data technology in the study, from the angle of law is still relatively blank. At present, China's criminal law system is still the product of the traditional industrial society, facing the new problems appear in the society, through the judicial interpretation and the partial adjustment of the legal provisions so that they can properly overcome the lag. However, the development of the Internet information change rapidly. Security issues are more complex, which makes the current criminal law can not play a good role in information security. Limited to the old idea of legislation, the legal system of The threat of information security regulation is obviously insufficient, can not protect the new law comprehensively and effectively. The big data as a key force for social change, and has wide application and enormous potential value, so to establish a perfect legal system for large data protection imperative. Collection and processing for large data information related to personal information protection, security companies and the state. In the face of information technology triggered by this new security threats, we need to change the way of thinking, construct a system of criminal law to protect the legal interests of the information society to. In the era of big data, the development of information technology has spawned new legal rights and these new legal rights includes the original number of massive resources, cloud computing also contains such information computing resources. This law is increased by forcing us to establish information security The whole protection idea, first to strengthen regulation of peripheral crime, indirectly strengthen the crackdown on big data crime; second is the protection process will extend to the analysis of large data, so as to achieve effective protection of the data processing platform, to achieve massive data security risk prevention and control of isolated database; finally we need to change the protection of ideas, to achieve system of information security protection, the protection of the interests of the information age. Based on the analysis and interpretation of information technology and the legal norms, short board inquiry of information security risk existing criminal law system to deal with the new technology in the context of the show, the relevant suggestions are put forward, to look forward to to bring security risks to successfully deal with new information technology.
