【摘要】：隨著互聯(lián)網(wǎng)的興起、電子商務的發(fā)展，海外代購已經(jīng)越來越受到人們的青睞和追捧。較之于傳統(tǒng)商品交易方式，C2C模式下商務手段和環(huán)境發(fā)生了改變，直接導致了交易活動潛藏欺詐行為。對C2C海外代購中的欺詐問題進行研究和構(gòu)建法律規(guī)制，有利于適應多元化商品交易環(huán)境，填補海外代購領域法律空白，為C2C模式下海外代購提供法律依據(jù)和制度保障。 全文共分為三個部分。第一部分討論了C2C模式下海外代購中存在的欺詐法律問題。首先對代購過程中存在的欺詐行為進行了介紹，并分析了其形成原因。然后介紹了在現(xiàn)有法律體系下對欺詐問題進行追究存在的瓶頸,主要圍繞四個方面展開:法律適用、管轄確定、被告認定、購物網(wǎng)站法律地位界定。 第二部分討論C2C海外代購中防范欺詐的制度。包括針對交易者身份信息和商品服務信息而建立起的信息披露制度和從信用評價體系、失信違規(guī)監(jiān)督懲罰機制、個人信用評級信用報告三方面著手完善的社會信用體系。 第三部分討論解決C2C海外代購中存在的欺詐糾紛的機制構(gòu)建。主要從非訴機制、訴訟手段并借鑒國外相關領域的先進可行做法幾方面研究，從而試圖解決海外代購中存在的欺詐糾紛，以凈化網(wǎng)絡交易環(huán)境、維護交易者權(quán)益。
[Abstract]:With the rise of the Internet and the development of electronic commerce, overseas purchasing has been more and more popular and popular. Compared with the traditional commodity trading mode, the business means and environment have changed. The research on the fraud in C2C overseas purchasing and the construction of legal regulation are beneficial to adapt to the diversified commodity trading environment and fill the legal blank in the field of overseas purchasing. It provides legal basis and system guarantee for overseas purchasing under C 2 C mode. This paper is divided into three parts. The first part discusses the legal problems of fraud in overseas daigou under C2C mode. Firstly, the fraud in the process of daigou is introduced. Then it introduces the bottleneck existing in the investigation of fraud under the existing legal system, mainly focusing on four aspects: application of law, determination of jurisdiction, determination of defendant and definition of legal status of shopping website. The second part discusses the system of preventing fraud in C2C overseas purchase, including the information disclosure system and credit evaluation system, the mechanism of supervising and punishing breach of trust and violation of credit, which is based on the identity information of traders and the information of commodity and service. Personal credit rating credit report three aspects to improve the social credit system. The third part discusses the construction of the mechanism to solve the fraud dispute in C2C overseas purchase. In order to purify the network trading environment and protect traders' rights and interests, this paper tries to solve the fraud disputes in overseas daigou.
