【摘要】：在處理侵吞不法原因給付物的問題上,目前學界存在著一些不當觀念,如為了入罪而認為委托關系屬于侵占罪的保護法益,在涉及贓物盜竊時又認為占有屬于盜竊罪的保護法益,而在判斷不法原因給付物是否具有他人性從而是否屬于行為人代為保管的他人之物時,要么否定他人性,要么只承認給付者享有返還請求權的才具有他人性。這些觀念亟待糾正,這一方面有利于對侵吞不法原因給付物/委托物的行為準確加以定性,另一方面也可以促進相關問題的合理解決。
[Abstract]:At present, there are some improper ideas in the field of dealing with the problem of embezzlement, such as that the entrustment relation is regarded as the benefit of the protection law of the crime of embezzlement. When it comes to stolen goods theft, it is considered that possession belongs to the law of protection of larceny, and when judging whether the goods paid for the illegal reason have other humanity and thus belong to other people's things in the custody of the actor, they either negate the human nature of the other person. These ideas need to be rectified, which on the one hand is conducive to the accurate characterization of the act of misappropriation of the wrongful cause of giving / entrusting. On the other hand, it can also promote the reasonable solution of related problems.
