【摘要】：我國的量刑規(guī)范化改革是一項(xiàng)卓有成效、求真務(wù)實(shí)的改革。它既是對傳統(tǒng)審判實(shí)踐和理論方法的繼承和發(fā)展，也是對各種方法和實(shí)踐局限性的克服與超越。 量刑規(guī)范化改革注重從實(shí)體規(guī)范和程序規(guī)制兩個(gè)方面進(jìn)行調(diào)整：既注重將定量的方法引入定性分析中并堅(jiān)持定量分析與定性分析相結(jié)合，又通過建立相應(yīng)的量刑程序保證量刑公正公開的實(shí)現(xiàn)。同時(shí)，既借鑒國內(nèi)外成熟的研究成果，，又對其存在的問題進(jìn)行完善，逐漸形成具有中國特色的量刑規(guī)范化改革。 本文通過對相關(guān)概念的正確解讀使讀者對量刑規(guī)范化有正確深入的理解；通過對量刑改革前后對比進(jìn)程的闡述，凸顯出改革的必要性以及改革成果；通過對國內(nèi)外各種理論方法的比較，同時(shí)對于實(shí)踐中出現(xiàn)的問題進(jìn)行對策分析，理論聯(lián)系實(shí)踐，尋找出更適合我國量刑規(guī)范化改革的出路；通過實(shí)體規(guī)范與程序規(guī)制共同探索勾勒出對我國未來量刑規(guī)范化改革的展望。 本文的主要行文邏輯在于：我國長期以來形成的重定罪輕量刑觀念的弊端逐漸顯現(xiàn)，量刑問題逐漸得到人們的重視，尤其是同案異判所造成的社會影響直接推動(dòng)了量刑規(guī)范化改革的序幕。在這場自上而下的改革中，我國比較注重實(shí)效和實(shí)證研究，在宏觀的框架方針下循序漸進(jìn)、逐步推動(dòng)。為了有效地實(shí)施，首先應(yīng)該對量刑規(guī)范化的相關(guān)概念進(jìn)行闡述解讀，對于一直以來存在的誤讀進(jìn)行糾正，對于與量刑規(guī)范化有關(guān)的相關(guān)概念進(jìn)行辨析。緊接著，在對于理論層面的概念闡釋清晰之后，就應(yīng)該針對具體試點(diǎn)中的問題進(jìn)行有針對性的研究。本文作者通過對最高法院確定的地方試點(diǎn)法院中的典型模式進(jìn)行研究，從而針對量刑規(guī)范化改革中的各種嘗試進(jìn)行逐一分析，其中包括實(shí)體上的諸如電腦量刑、《美國聯(lián)邦量刑指南》以及程序上的構(gòu)建相對獨(dú)立的量刑程序。最后，作者對于本文進(jìn)行總結(jié)與展望，對于需要解決的問題提出以有利于量刑規(guī)范化改革朝著適合中國國情的方向逐步完善與發(fā)展。 本文的創(chuàng)新之處在于，以往的研究結(jié)果一般只是針對其中一個(gè)側(cè)面進(jìn)行剖析，雖然深入但是并不全面。筆者則是在橫向?qū)Ρ雀鱾�(gè)理論方法和實(shí)踐經(jīng)驗(yàn)的基礎(chǔ)上縱向分析各個(gè)制度以及方法的優(yōu)缺點(diǎn)，辯證和發(fā)展地看待問題以尋找最適合我國量刑規(guī)范化改革的發(fā)展路徑。
[Abstract]:The reform of sentencing standardization in our country is a fruitful and pragmatic reform, which not only inherits and develops the traditional judicial practice and theoretical methods, but also overcomes the limitations of various methods and practices. The reform of sentencing standardization focuses on the adjustment of substantive norms and procedural regulations. It not only emphasizes the introduction of quantitative methods into qualitative analysis, but also insists on the combination of quantitative analysis and qualitative analysis. At the same time, by establishing the corresponding sentencing procedures to ensure the realization of sentencing justice and openness. At the same time, we can learn from the mature research results at home and abroad, and perfect the existing problems, and gradually form the standardized reform of sentencing with Chinese characteristics. Through the correct interpretation of relevant concepts, readers have a correct and in-depth understanding of sentencing standardization, through the comparison of the process of sentencing reform before and after the elaboration, highlight the necessity of reform and reform results; Through the comparison of various theories and methods at home and abroad, at the same time, the countermeasures for the problems in practice are analyzed, and the theory is combined with practice to find out a way out that is more suitable for the reform of sentencing standardization in our country. Through the substantive norms and procedural regulations to explore and outline the future reform of sentencing standardization prospects. The main logic of this paper lies in: the malpractice of the concept of emphasizing conviction and light sentencing, which has been formed for a long time in our country, has gradually appeared, and the problem of sentencing has been paid more and more attention by people. In particular, the social impact caused by different judgments in the same case directly promotes the prelude to the standardized reform of sentencing. In this top-down reform, our country pays more attention to practical results and empirical research, and proceeds step by step under the macro-framework policy. Step by step. In order to effectively implement, first of all, we should expound and interpret the relevant concepts of sentencing standardization, correct the misreading that has always existed, and discriminate and analyze related concepts related to the standardization of sentencing. After explaining the concept of the theory level clearly, we should make a targeted study on the problems in the specific pilot projects. The author studies the typical models in the local pilot courts determined by the Supreme Court. Thus, the various attempts in the reform of the standardization of sentencing are analyzed one by one, including, in substance, such as computer sentencing, the United States Federal sentencing Guide, and the construction of relatively independent sentencing procedures in the procedure. Finally, The author summarizes and looks forward to the problems that need to be solved and puts forward that the reform of sentencing standardization should be perfected and developed step by step in a direction suitable for China's national conditions. The innovation of this paper lies in the fact that the previous research results are generally only aimed at one aspect of the analysis. Although deep but not comprehensive, the author analyzes the merits and demerits of various systems and methods on the basis of horizontal comparison of various theoretical methods and practical experiences. Dialectical and developmental view of the problem in order to find the most suitable for China's sentencing standardization reform development path.
