【摘要】：金融監(jiān)管部門對非法金融活動的性質認定曾是公安機關啟動非法集資案件立案偵查司法程序的前置條件。隨著金融改革的不斷深入,我國金融法律體系不健全的弊端開始顯現(xiàn),而國家政策對民間資本向金融業(yè)滲透的鼓勵,對在普惠金融旗幟下進行的各種金融創(chuàng)新試錯的寬容,使得缺乏有效金融監(jiān)管下的各類民間融資活動的風險逐漸凸顯,非法集資案件頻發(fā)。部際聯(lián)席會議制度的創(chuàng)建和各級地方政府針對非法集資成立了處置辦公室,使各級政府逐漸取代金融監(jiān)管部門成為對非法集資案件認定、查處和后續(xù)處置的實際主導者,金融監(jiān)管部門的職能逐漸被邊緣化。非法集資案件的查處涉及立法、司法、經濟金融政策和社會穩(wěn)定諸問題,而以維穩(wěn)為目標、追求最大限度挽回受害人損失的非法集資處置工作成效評價,使公安機關不合適地承擔了應屬于法院職責范圍內的責令退賠、追繳財產等執(zhí)行工作。應反思非法集資犯罪規(guī)制的目標所在,并據此修訂法律和進行司法糾偏,同時,應審慎考量地方政府、金融監(jiān)管部門在查處非法集資活動中的角色定位與權限賦予。
[Abstract]:The recognition of the nature of illegal financial activities by the financial supervision department was the precondition for the public security organs to initiate the judicial procedure of filing and investigating illegal fund-raising cases. With the deepening of the financial reform. The malpractice of unsound financial legal system of our country begins to appear, and the national policy encourages the folk capital to infiltrate into the financial industry, and tolerates the trial and error of all kinds of financial innovation under the banner of inclusive finance. The lack of effective financial supervision of various types of private financing activities risk gradually highlighted, illegal fund-raising cases occurred frequently. The establishment of the inter-ministerial joint meeting system and local governments at all levels of illegal fund-raising set up a disposal office. So that governments at all levels gradually replace the financial supervision department as the actual leader in the identification, investigation and subsequent disposal of illegal fund-raising cases. The function of the financial supervision department is gradually marginalized. The investigation and treatment of the illegal financing cases involves the legislation, the judicature, the economic and financial policy and the social stability, and the goal is to maintain the stability. Pursuit of maximum recovery of the victim of the loss of illegal fund-raising and disposal of the effectiveness evaluation, so that the public security organs do not properly bear the responsibility of the court should be ordered to refund compensation. We should reflect on the target of the regulation of illegal fund-raising crime and revise the law and carry on judicial correction accordingly. At the same time, we should carefully consider the local government. Financial supervision department in the investigation and punishment of illegal fund-raising activities in the role of positioning and empowerment.
