【摘要】：2009年震動(dòng)學(xué)界與司法界的"鄧玉嬌案",使我國《刑法》第20條第3款規(guī)定的無限防衛(wèi)權(quán)得到了社會(huì)的關(guān)注。無限防衛(wèi)權(quán)的建立,更好地發(fā)揮了懲罰犯罪的功能。立法及司法實(shí)踐鼓勵(lì)并提倡的自行防衛(wèi)觀念和行為,使某些暴力犯罪得到了沉重的打擊,從而促進(jìn)社會(huì)治安狀況的逐漸好轉(zhuǎn)。而對(duì)于暴力犯罪份子來說,無限防衛(wèi)權(quán)的規(guī)定能夠使其產(chǎn)生畏懼心理,但凡在這些暴力犯罪中被致重傷或者死亡的行為人只能是自取其禍、作繭自縛,這都表明了設(shè)立無限防衛(wèi)權(quán)的必要性。
[Abstract]:In 2009, the case of Deng Yujiao, which shocked the academic and judicial circles, made the unlimited defense right stipulated in the third paragraph of Article 20 of the Criminal Law of our country get the attention of the society and the establishment of the unlimited defense right. The concept and behavior of self-defense encouraged and advocated by legislation and judicial practice have given a heavy blow to some violent crimes. To promote the gradual improvement of the social security situation. But for violent criminals, the provisions of unlimited defense rights can make them fear. However, the perpetrators who are seriously injured or killed in these violent crimes can only do their own harm and bind themselves, which shows the necessity of establishing unlimited right of defense.
