【摘要】：正當(dāng)下,"憲政"一詞成了學(xué)界比較敏感的話題。要使"憲政"問題在有價值的學(xué)術(shù)意義上科學(xué)地加以探討,必須要對"憲政"概念作為漢語的專門術(shù)語其辭源學(xué)的意義加以認(rèn)真考察,同時還要對"憲政"概念"能指"的社會現(xiàn)象做出正確的評估,否則,在學(xué)術(shù)上簡單地拋棄"憲政"一詞會引發(fā)更嚴(yán)重和復(fù)雜的理論問題與政策上的被動。從法理上來看,要考察"憲政"概念所指向的社會現(xiàn)象,應(yīng)當(dāng)明確地區(qū)分兩個學(xué)術(shù)命題:
[Abstract]:Just then, the term "constitutionalism" has become a more sensitive topic in academic circles. In order to make the issue of "constitutionalism" scientifically and scientifically explored in a valuable academic sense, we must carefully investigate the meaning of the concept of "constitutionalism" as a special term in Chinese and its etymology. At the same time, it is necessary to make a correct assessment of the social phenomenon of "signifier" in the concept of "constitutionalism", otherwise, simply abandoning the word "constitutionalism" in academic circles will lead to more serious and complicated theoretical problems and policy passivity. From the legal point of view, in order to investigate the social phenomena pointed to by the concept of "constitutionalism", we should clearly distinguish two academic propositions:
