【摘要】：憲法社會(huì)學(xué)是關(guān)于憲法的社會(huì)學(xué)研究,是憲法學(xué)與社會(huì)學(xué)交叉融合的產(chǎn)物,旨在發(fā)現(xiàn)人類政治生活中的真實(shí)規(guī)則。在歐洲和北美,憲法社會(huì)學(xué)已經(jīng)形成了多元化的學(xué)術(shù)傳統(tǒng)。其中,德國(guó)的憲法社會(huì)學(xué)側(cè)重于從政治與歷史的角度切入,偏好史論結(jié)合,思辨色彩濃厚。法國(guó)的憲法社會(huì)學(xué)具有客觀的、旁觀者的敘事風(fēng)格。英國(guó)的憲法社會(huì)學(xué)打上了判例法或不成文憲法的痕跡,致力于素描一部活生生的憲法,仿佛人類學(xué)家的調(diào)查報(bào)告。美國(guó)雖然承襲了英國(guó)的判例法制度,但美國(guó)的憲法社會(huì)學(xué)透出強(qiáng)烈的現(xiàn)實(shí)主義意味,憲法背后的經(jīng)濟(jì)關(guān)系、利益格局得到了凸顯。梳理歐美憲法社會(huì)學(xué)的學(xué)術(shù)傳統(tǒng),比較歐美各國(guó)憲法社會(huì)學(xué)的不同旨趣,有助于為當(dāng)代中國(guó)憲法社會(huì)學(xué)的穩(wěn)步發(fā)展提供理論與方法論上的啟示。
[Abstract]:Constitutional sociology is a sociological study of constitution, which is the product of the combination of constitutional jurisprudence and sociology, aiming at discovering the true rules in human political life. In Europe and North America, constitutional sociology has formed a pluralistic academic tradition. Among them, Germany's constitutional sociology focuses on the political and historical perspective, preference for the combination of historical theory, strong speculative color. French constitutional sociology has an objective and onlooker narrative style. British constitutional sociology marks the trail of case law or unwritten constitution, working on sketching a living constitution, like an anthropologist's investigation. Although the United States inherited the British case law system, but the American constitutional sociology revealed a strong sense of realism, the economic relationship behind the constitution, the pattern of interests has been highlighted. Combing the academic tradition of constitutional sociology in Europe and the United States, and comparing the different purport of constitutional sociology in Europe and the United States, will help to provide theoretical and methodological enlightenment for the steady development of constitutional sociology in contemporary China.
