【摘要】：互聯(lián)網(wǎng)的快速發(fā)展極大的擴展了我們傳統(tǒng)生活的邊界,憲法賦予每一個公民的自由權(quán)利也在這樣一個廣闊的虛擬空間里得到了新的詮釋,尤其是以言論自由為基礎(chǔ)的憲法性權(quán)利,不僅促進(jìn)了公民言論自由表達(dá)的積極性,也促使網(wǎng)絡(luò)言論成為現(xiàn)代人權(quán)觀念的新延伸。但是網(wǎng)絡(luò)言論自由也帶了一些負(fù)面的效果,它很大程度上打破了言論自由的傳統(tǒng)法律界限的平衡,對政府的網(wǎng)絡(luò)監(jiān)管形成了新的挑戰(zhàn)。我國對于網(wǎng)絡(luò)言論的監(jiān)管,經(jīng)歷了一個過程,從開始簡單粗暴的行政干預(yù),削弱了公民言論自由權(quán)利的同時也造成了社會的普遍壓抑；到隨后重視法律的規(guī)制,認(rèn)識到只有從“嚴(yán)管”與“放任”中找到平衡點,把握監(jiān)管度的平衡,實現(xiàn)網(wǎng)絡(luò)監(jiān)管的逐步法制化,才能從根本上解決問題。本文從網(wǎng)絡(luò)言論監(jiān)管的相關(guān)概念入手,分別介紹了網(wǎng)絡(luò)言論自由和監(jiān)管的概念,并提及我國網(wǎng)絡(luò)言論監(jiān)管的歷史沿襲和監(jiān)管的方式手段,并闡述了網(wǎng)絡(luò)言論監(jiān)管的理論基礎(chǔ),表明網(wǎng)絡(luò)言論監(jiān)管的必要性和緊迫性。然后介紹我國網(wǎng)絡(luò)言論監(jiān)管存在的法律問題及原因分析。從立法、執(zhí)法、司法三方面論述我國網(wǎng)絡(luò)監(jiān)管中存在的法律問題,針對這些問題,運用一些經(jīng)典理論剖析其產(chǎn)生的原因。接下來介紹了國外網(wǎng)絡(luò)言論監(jiān)管的法律經(jīng)驗及啟示。主要從國外網(wǎng)絡(luò)言論監(jiān)管的法律經(jīng)驗,介紹3個典型國家網(wǎng)絡(luò)言論監(jiān)管的不同策略和方式,從中得出我國需要借鑒的最佳手段和網(wǎng)絡(luò)言論監(jiān)管的未來走向。最后提出完善我國網(wǎng)絡(luò)言論監(jiān)管的法律對策。提出從立法完善、行政執(zhí)法的監(jiān)督、司法保障和救濟、行業(yè)自律機制完善和個人權(quán)利約束四個大的方面來完善我國的網(wǎng)絡(luò)言論監(jiān)管。
[Abstract]:The rapid development of the Internet has greatly expanded the boundaries of our traditional life, and the constitutional right to freedom of every citizen has been interpreted in such a vast virtual space. Especially the constitutional right based on the freedom of speech not only promotes the enthusiasm of citizens to express freely, but also promotes the Internet speech to become a new extension of the modern concept of human rights. However, the freedom of online speech also has some negative effects, which to a large extent has broken the balance of the traditional legal boundaries of freedom of speech, and has posed a new challenge to the government's network supervision. The supervision of Internet speech in our country has gone through a process, from the beginning of simple and rude administrative intervention, which weakened the citizens' right to freedom of speech, but also caused widespread social repression, and then attached importance to the regulation of the law. It is recognized that only by finding a balance between "strict control" and "laissez-faire", grasping the balance of supervision degree and realizing the gradual legalization of network supervision, can the problem be solved fundamentally. Starting with the related concepts of network speech supervision, this paper introduces the concepts of network speech freedom and supervision, and points out the historical succession of our country's network speech regulation and the ways and means of supervision, and expounds the theoretical basis of network speech supervision. Show the necessity and urgency of network speech regulation. Then it introduces the legal problems and causes of network speech supervision in our country. This paper discusses the legal problems existing in China's network supervision from three aspects of legislation, law enforcement and judicature, and analyzes the causes of these problems by using some classical theories. Then it introduces the legal experience and enlightenment of foreign network speech supervision. This paper mainly introduces the different strategies and methods of online speech regulation in three typical countries from the legal experience of foreign countries, and points out the best means to be used for reference and the future trend of online speech regulation in China. Finally, it puts forward the legal countermeasures to perfect the supervision of network speech in our country. This paper puts forward four aspects to perfect the supervision of network speech in our country, such as the perfection of legislation, the supervision of administrative law enforcement, the judicial guarantee and relief, the perfection of self-discipline mechanism of industry and the restriction of individual rights.
