【摘要】：如何加強(qiáng)法院自身建設(shè),提升司法公信與權(quán)威是當(dāng)前我國法院亟待解決的重大現(xiàn)實(shí)問題。本文在對我國現(xiàn)行協(xié)議管轄和案件分配制度進(jìn)行重新審視的基礎(chǔ)上,通過構(gòu)建一種全新的當(dāng)事人合意選定法院、法官制度模式,把司法服務(wù)競爭機(jī)制引入法院自身建設(shè),以此形成對法院、法官科學(xué)客觀的評價監(jiān)督機(jī)制,在促進(jìn)當(dāng)事人合法權(quán)益保護(hù)的同時,推進(jìn)法官個體和團(tuán)隊的精英化,實(shí)現(xiàn)當(dāng)事人合法權(quán)益保護(hù)與增強(qiáng)法院自身建設(shè)的良性互動,以此達(dá)到維護(hù)司法裁判的既判力和穩(wěn)定性,提升司法公信與權(quán)威的最終目的。
[Abstract]:How to strengthen the construction of the court itself and improve the judicial trust and authority is an important practical problem to be solved urgently in the courts of our country at present. On the basis of re-examining the current system of agreement jurisdiction and case distribution in our country, this paper constructs a new court and judge system model, and introduces the competition mechanism of judicial service into the construction of the court itself, so as to form a scientific and objective evaluation and supervision mechanism for the court and the judge, which not only promotes the protection of the legitimate rights and interests of the parties, but also promotes the excellence of the individual and team of the judge. To realize the benign interaction between the protection of the legitimate rights and interests of the parties and the construction of the court itself, so as to achieve the ultimate goal of maintaining the res judicata and stability of judicial judgment and promoting judicial public trust and authority.
