【摘要】：我國(guó)定期金賠償作為一次性賠償方式的補(bǔ)充,自建立起因缺乏配套變更制度而難以實(shí)施,造成賠償權(quán)利人無(wú)法據(jù)此獲得應(yīng)有救濟(jì)。推行定期金判決,必須構(gòu)建定期金賠償變更制度。德、日兩國(guó)變更判決之訴對(duì)定期金賠償變更之適用采取寬松與限制兩種對(duì)立態(tài)度,并據(jù)此發(fā)展不同制度。我國(guó)為推行判決終局性應(yīng)借鑒日本做法,以維護(hù)定期金判決之訴既判力為宗旨構(gòu)建定期金賠償變更條款,要求作為定期金賠償變更依據(jù)的“新情況、新理由”必須發(fā)生于前訴口頭辯論終結(jié)之后,客觀上不可被預(yù)見并具有重大性。
[Abstract]:As a supplement of the one-time compensation, the periodic compensation in China is difficult to be implemented because of the lack of matching alteration system, which results in the obligee of compensation being unable to obtain due relief. To carry out periodic payment judgment, we must construct the system of periodic compensation change. Germany and Japan adopt two opposing attitudes of leniency and restriction on the application of periodic compensation change, and develop different systems accordingly. In order to carry out the final judgment, our country should draw lessons from the Japanese practice, construct the term of alteration of periodic compensation in order to maintain the res judicata of periodic gold judgment, and demand the new situation as the basis for the alteration of periodic gold compensation. The new reason "must take place after the conclusion of the oral argument, objectively unforeseeable and significant."
