【摘要】：建立海洋環(huán)境資源案件的審前程序既是法院優(yōu)化配置審判資源、提高審前工作效率的現(xiàn)實需要,也是海洋環(huán)境資源案件要求程序法"綠化"的因應對策。立案登記制急需配套的程序疏導機制,法官員額制改革要求法院優(yōu)化司法資源配置,建立完善民事訴訟審前程序。建議修改我國《海事訴訟特別程序法》時,結合海事案件的特點,明確海事訴訟的審前程序,對海事案件的管轄審查、訴答、送達、保全、證據(jù)交換、庭前會議、繁簡分流、審前調(diào)解等內(nèi)容予以規(guī)定,并特別規(guī)定海洋環(huán)境資源案件的訴訟主體資格審查機制、特邀調(diào)解機制,以利于發(fā)揮審前程序為庭審及裁判打好基礎或終結訴訟的雙重功效。
[Abstract]:The establishment of pretrial procedure for marine environment and resources cases is not only the practical need for the court to optimize the allocation of trial resources and improve the efficiency of pre-trial work, but also the countermeasures for "greening" of the procedural law of marine environmental resources cases. The registration system needs a necessary procedure guidance mechanism. The reform of the judge post system requires the court to optimize the allocation of judicial resources and to establish and perfect the pretrial procedure of civil proceedings. It is suggested that, when amending the Special procedure Law of Maritime Litigation of our country, combining the characteristics of maritime cases, the pretrial procedure of maritime litigation, the jurisdiction examination, pleading, service, preservation, evidence exchange, pre-trial meeting, complicated and simple diversion of maritime cases should be clarified. Pre-trial mediation and other contents should be stipulated, especially the qualification examination mechanism of marine environment and resources cases and the specially invited mediation mechanism, so as to give full play to the dual effect of pretrial procedure to lay a good foundation for trial and adjudication or to terminate litigation.
