【摘要】：在刑事訴訟過程中,對于檢、法機(jī)關(guān)適用疑罪從無原則并無爭議。偵查機(jī)關(guān)是否適用疑罪從無以及如何適用則未形成共識。偵查階段存在疑罪是一種客觀存在,在現(xiàn)有法律框架內(nèi)無法處理疑罪問題。在偵查階段確立疑罪從無原則有其合理性。為解決疑罪的適用問題,應(yīng)該在保持現(xiàn)有的撤案條件不變的基礎(chǔ)上,修改相關(guān)法律規(guī)定,拓展終止偵查的適用條件,賦予偵查機(jī)關(guān)疑罪終止偵查的建議權(quán),決定權(quán)在檢察院,加強(qiáng)公安、檢察機(jī)關(guān)在疑罪案件終止偵查中的相互制約,規(guī)定疑罪案件終止偵查的適用期限。
[Abstract]:In the process of criminal proceedings, there is no dispute about the application of suspected crimes by legal organs. There is no consensus as to whether or not the investigation organ applies the suspected crime and how to apply it. The existence of suspected crime in the investigation stage is an objective existence and can not be dealt with within the existing legal framework. It is reasonable to establish the suspect crime in the investigation stage. In order to solve the problem of the application of the suspected crime, we should, on the basis of keeping the existing conditions of withdrawing the case unchanged, amend the relevant legal provisions, expand the applicable conditions for terminating the investigation, endow the investigative organ with the right of suggestion to terminate the investigation of the suspected crime, and make the decision in the procuratorate. To strengthen the mutual restriction of the public security and procuratorial organs in the investigation of the termination of the suspected crime case, and to stipulate the applicable time limit for the termination of the investigation of the suspected crime case.
