【摘要】：職務(wù)犯罪初查是檢察機(jī)關(guān)對(duì)于職務(wù)犯罪案件線索材料,依法在必要時(shí)所進(jìn)行的立案前調(diào)查活動(dòng)。作為偵查的前提與基礎(chǔ),初查和偵查共同服務(wù)于查明案件事實(shí)的辦案過程中。職務(wù)犯罪初查制度一直是在不斷的爭(zhēng)議中發(fā)展完善的,初查實(shí)踐工作也是伴隨著爭(zhēng)議而不斷探索前行,2012年刑事訴訟法的修改給初查制度的變革帶來了新的契機(jī)。其中,最重要的表征是最高人民檢察院制定并組織實(shí)施《人民檢察院直接受理偵查案件初查工作規(guī)定(試行)》,該規(guī)定提出了職務(wù)犯罪案件初查工作的新要求,也彰顯著初查發(fā)展的新動(dòng)向,即職務(wù)犯罪案件初查將在現(xiàn)有體制范圍內(nèi)進(jìn)行全面延展。鑒于當(dāng)前職務(wù)犯罪日益復(fù)雜且十分嚴(yán)峻的形勢(shì),初查制度越來越發(fā)揮重要的作用,可以說成為實(shí)踐中偵破案件的關(guān)鍵。然而,職務(wù)犯罪初查實(shí)踐中遇到的初查方法不夠、信息渠道不暢、權(quán)力配置不實(shí)、監(jiān)督機(jī)制不力及證據(jù)資格不足等困境,表明職務(wù)犯罪初查面臨越來越多的挑戰(zhàn)。因此,對(duì)職務(wù)犯罪初查進(jìn)行延展是非常有必要的。本文就職務(wù)犯罪初查的延展等若干問題進(jìn)行了初步的探究,以期在此基礎(chǔ)上能更好地研究職務(wù)犯罪初查制度,為職務(wù)犯罪初查實(shí)踐工作提供思路。本文除第一章引言和文章的結(jié)語部分外,主體內(nèi)容共分為四章。第二章論述了職務(wù)犯罪初查的含義,闡述了職務(wù)犯罪初查與立案、偵查的關(guān)系,然后介紹了職務(wù)犯罪初查規(guī)則的變遷,以表明職務(wù)犯罪初查在我國的一個(gè)大致發(fā)展脈絡(luò)。第三章先介紹了職務(wù)犯罪初查存在的現(xiàn)實(shí)困境,接著再闡述了職務(wù)犯罪初查延展的理論基礎(chǔ),以表明對(duì)職務(wù)犯罪初查進(jìn)行延展之必要。第四章介紹了《人民檢察院直接受理偵查案件初查工作規(guī)定(試行)》中有關(guān)初查延展的具體內(nèi)容。第五章分析了職務(wù)犯罪初查延展的風(fēng)險(xiǎn)及防范。
[Abstract]:The initial investigation of duty crime is a pre-filing investigation carried out by the procuratorial organ in accordance with the law with regard to the clue material of the duty crime case. As the premise and basis of investigation, initial investigation and investigation serve the process of finding out the facts of a case. The system of initial investigation of duty crime has been developed and perfected in the constant controversy, and the practice of initial investigation has also been continuously explored along with the controversy. The revision of the criminal procedure law in 2012 has brought a new opportunity to the reform of the system of initial investigation. Among them, the most important representation is that the Supreme people's Procuratorate formulates and organizes the implementation of the regulations on the initial investigation of cases directly accepted by the people's Procuratorates (trial), which set new requirements for the initial investigation of job-related crimes. It also highlights the new trend of initial investigation, that is, the initial investigation of job-related crimes will be fully extended within the existing system. In view of the increasingly complex and severe situation of duty crime at present, the system of initial investigation plays an important role more and more, and it can be said to be the key to solve cases in practice. However, the difficulties encountered in the practice of initial investigation of job-related crimes, such as insufficient methods of initial investigation, poor channels of information, improper allocation of power, weak supervision mechanism and insufficient evidentiary qualifications, indicate that the initial investigation of job-related crimes is facing more and more challenges. Therefore, it is necessary to extend the initial investigation of duty crime. This paper makes a preliminary study on the extension of the initial investigation of job-related crime in order to better study the system of the initial investigation of the job-related crime on this basis and to provide some ideas for the practical work of the initial investigation of the job-related crime. In addition to the introduction of the first chapter and the conclusion of the article, the main content is divided into four chapters. The second chapter discusses the meaning of the initial investigation of duty crime, expounds the relationship between the initial investigation of duty crime and the filing and investigation of duty crime, and then introduces the changes of the rules of initial investigation of duty crime, in order to show the general development of the initial investigation of duty crime in our country. The third chapter first introduces the practical predicament of the initial investigation of duty crime, and then expounds the theoretical basis of the extension of the initial investigation of duty crime, in order to show the necessity of the extension of the initial investigation of duty crime. Chapter four introduces the concrete contents of the regulations on the initial investigation of the people's Procuratorate's Direct acceptance of investigation cases (trial). Chapter five analyzes the risk and prevention of the initial investigation and extension of duty crime.
