【摘要】：英國的認(rèn)罪協(xié)商制度的全面擴(kuò)張始于20世紀(jì)90年代。追溯相關(guān)判例法及成文法的演進(jìn)過程,英國刑事司法立法與實(shí)踐不斷強(qiáng)化認(rèn)罪行為的制度性便利,認(rèn)罪協(xié)商制度呈現(xiàn)出適用范圍擴(kuò)張、階段提前、分流加強(qiáng)的發(fā)展態(tài)勢(shì)。同時(shí),這種擴(kuò)張態(tài)勢(shì)與案件事實(shí)、被指控人基本權(quán)利、被害人地位之間的關(guān)系亦日趨緊張,進(jìn)而引發(fā)英國刑事訴訟法整體制度框架上的協(xié)調(diào)與整合。參考英國認(rèn)罪協(xié)商之制度流變,并對(duì)比中國當(dāng)前以認(rèn)罪認(rèn)罰從寬為典型的相關(guān)制度,形成基于被指控人認(rèn)罪行為構(gòu)建從寬處置規(guī)則的四項(xiàng)基本原則,即案件事實(shí)真相優(yōu)先原則,被指控人基本權(quán)利最低限度保障原則,認(rèn)罪行為與從寬處置之合比例原則,協(xié)商之負(fù)面外部性最小化原則。
[Abstract]:The overall expansion of Britain's plea bargaining system began in the 1990 s. Tracing back to the evolution process of relevant case law and statutory law, the criminal justice legislation and practice in Britain constantly strengthen the institutional convenience of guilty pleas, and the plea bargaining system presents a trend of expansion of applicable scope, advance of stage and strengthening of diversion. At the same time, this expansion situation and the facts of the case, the basic rights of the accused, and the relationship between the status of the victims are also increasingly tense, which leads to the coordination and integration of the overall system of the British Criminal procedure Law. Referring to the evolution of the system of plea bargaining in Britain, and comparing the current relevant systems in China with leniency of plea and punishment, four basic principles, namely, the principle of giving priority to the truth of the facts of the case, are formed, which are based on the guilty plea behavior of the accused person to construct the lenient treatment rule. The principle of minimum protection of basic rights of accused person, the principle of proportionality between guilty plea and leniency, the principle of minimization of negative externality of negotiation.
