【摘要】：本文在現(xiàn)有的研究基礎(chǔ)上，以當(dāng)事人收集證據(jù)的程式為中心展開對民事訴訟當(dāng)事人證據(jù)收集的剖析，試圖以一種理想的樣式呈現(xiàn)收集證據(jù)的應(yīng)然面相。通過結(jié)合司法實踐的案例，從證據(jù)收集的指涉客體——證據(jù)種類入手，分析收集證據(jù)的一般程式和特殊程式，并就如何保障運作提出完善的建議。 除前言和結(jié)語外，正文共由四部分組成，具體結(jié)構(gòu)如下： 第一章：民事訴訟證據(jù)收集的畛域。本章運用訴訟方法論對民事訴訟證據(jù)種類進(jìn)行探討，在指出我國證據(jù)種類立法模式給證據(jù)收集帶來實踐困境的同時就如何完善提出改進(jìn)的意見。 第二章：民事訴訟當(dāng)事人證據(jù)收集的一般程式。以證據(jù)收集程式內(nèi)在機(jī)理的梳理為基礎(chǔ)，針對不同的取證對象，進(jìn)行考察分析，并就如何完善向?qū)Ψ疆?dāng)事人、證人、第三人收集證據(jù)的程序提出建議。 第三章：民事訴訟當(dāng)事人證據(jù)收集的特殊程式。以需要法院介入才能產(chǎn)生啟動程序的效果為標(biāo)準(zhǔn)，將當(dāng)事人向法院申請調(diào)查取證、申請證據(jù)保全、通過證據(jù)交換發(fā)現(xiàn)證據(jù)界定為民事訴訟當(dāng)事人證據(jù)收集的特殊程式，并試圖擴(kuò)充其證據(jù)收集的功能。 第四章：民事訴訟當(dāng)事人證據(jù)收集的保障。一方面探索保障當(dāng)事人證據(jù)收集程序運作的措施，另一方面，關(guān)注取證對象合法權(quán)益的保障。首次提出在法院建立征信系統(tǒng)，，將不配合證據(jù)收集的個人或單位的信息進(jìn)行采集和整理，作為其涉訟并向法院申請調(diào)查取證，法院裁量是否準(zhǔn)予申請的因素。
[Abstract]:On the basis of the existing research, this paper takes the procedure of collecting evidence as the center to analyze the collection of evidence in civil litigation, and tries to present the face of collecting evidence in an ideal way. Based on the case of judicial practice, this paper analyzes the general and special procedures of evidence collection from the point of view of the object involved in evidence collection-the types of evidence, and puts forward some suggestions on how to ensure the operation of evidence collection. In addition to the preface and conclusion, the text is composed of four parts, the specific structure is as follows: Chapter one: the field of evidence collection in civil proceedings. This chapter probes into the types of evidence in civil litigation by means of litigation methodology, and points out that the legislative model of evidence types in our country has brought practical difficulties to the collection of evidence, and at the same time puts forward some suggestions on how to improve it. Chapter two: the general procedure of evidence collection in civil litigation. On the basis of combing the internal mechanism of evidence collection program, this paper investigates and analyzes different evidential objects, and puts forward some suggestions on how to perfect the procedure of collecting evidence from the other party, witness and third party. Chapter three: the special procedure for collecting evidence in civil litigation. Based on the criterion that court intervention is required to produce the effect of initiating proceedings, the parties concerned are defined as a special procedure for collecting evidence in civil litigation by applying to the court for investigation and evidence preservation, and for the discovery of evidence through evidence exchange. And attempts to expand its evidence collection function. Chapter IV: the protection of the collection of evidence by the parties in civil proceedings. On the one hand, it explores the measures to ensure the operation of the party's evidence-gathering procedure, on the other hand, pays attention to the protection of the lawful rights and interests of the object. It is proposed for the first time to set up a credit system in the court to collect and organize the information of individuals or units that do not cooperate with the evidence collection as a factor of litigating and applying to the court to investigate and obtain evidence, and whether the court can grant the application or not.
