【摘要】：作為《生態(tài)環(huán)境損害賠償制度改革試點(diǎn)方案》實(shí)施后法院辦結(jié)的首例案件,貴州省人民政府提起的生態(tài)環(huán)境損害賠償司法確認(rèn)案受到了各方的廣泛關(guān)注�；仡櫾摪�,可以發(fā)現(xiàn)其在司法確認(rèn)制度的適用范圍和程序設(shè)置方面進(jìn)行了創(chuàng)新,推動(dòng)了生態(tài)環(huán)境損害賠償多元化糾紛解決機(jī)制的發(fā)展;同時(shí)就司法確認(rèn)的審查標(biāo)準(zhǔn)、確認(rèn)后的救濟(jì)以及確認(rèn)書的既判力問題引發(fā)了新的思考。
[Abstract]:As the first case handled by the court after the implementation of the "pilot Program on the Reform of the system of compensation for Ecological Environment damage", the judicial confirmation of the compensation for ecological environmental damage initiated by the people's Government of Guizhou Province has received extensive attention from all sides. Recalling this case, it can be found that it has made innovations in the scope of application and procedural set-up of the judicial confirmation system, which has contributed to the development of a pluralistic dispute resolution mechanism for ecological environmental damage compensation, and at the same time regarding the review criteria for judicial confirmation, The relief after confirmation and the res judicata of the confirmation have caused new thinking.
