【摘要】：裁判文書說理責(zé)任是一種司法責(zé)任。三大訴訟法及其司法解釋中有關(guān)裁判文書說理責(zé)任的規(guī)定不夠平衡和系統(tǒng),尤其缺乏配套的保障機(jī)制。從說理規(guī)律出發(fā)進(jìn)行分析,說理責(zé)任制度存在雙重核心:一是圍繞"裁判結(jié)論"進(jìn)行說理,履行最高目標(biāo)責(zé)任;二是針對(duì)"爭議焦點(diǎn)"進(jìn)行說理,履行最低目標(biāo)責(zé)任。立足于當(dāng)前司法改革背景,應(yīng)當(dāng)建立健全裁判文書說理責(zé)任的系列保障機(jī)制:以說理公開條款保障說理責(zé)任到位,以說理權(quán)力條款促進(jìn)說理主體有為,以說理目標(biāo)、標(biāo)準(zhǔn)條款提升說理整體水平,以考核激勵(lì)措施條款調(diào)動(dòng)說理積極性,以內(nèi)外部評(píng)價(jià)條款促進(jìn)說理效果實(shí)現(xiàn)。
[Abstract]:The judgment document reasoning responsibility is a kind of judicial responsibility.The provisions of the three procedural laws and their judicial interpretations on the reasoning responsibility of the adjudicative documents are not balanced and systematic, especially lack of supporting safeguard mechanism.Proceeding from the law of reasoning, the system of reasoning responsibility has dual core: one is to reason around "judgment conclusion" to fulfill the highest objective responsibility; the other is to reason about "dispute focus" and fulfill the lowest objective responsibility.Based on the background of the current judicial reform, we should establish and improve the series of safeguard mechanisms of the reasoning responsibility of the judgment document: to protect the reasoning responsibility with the argument open clause, to promote the reasoning subject with the reasoning power clause, and to aim at the reasoning.The standard clause promotes the overall level of reasoning, motivates the enthusiasm of reasoning by examining the terms of incentive measures, and promotes the effect of reasoning by the provisions of internal and external evaluation.
