【摘要】：各國(guó)承認(rèn)與執(zhí)行外國(guó)懲罰性損害賠償判決的態(tài)度不同,主要因?yàn)樗麄儗?duì)懲罰性損害賠償金額的具體數(shù)額存在較大爭(zhēng)議。有的國(guó)家對(duì)懲罰性損害賠償判決全部承認(rèn)與執(zhí)行,也有國(guó)家全部拒絕承認(rèn)與執(zhí)行,還有國(guó)家部分承認(rèn)與執(zhí)行。隨著懲罰性損害賠償制度的自我完善,比例原則和分割方法的運(yùn)用對(duì)賠償標(biāo)準(zhǔn)產(chǎn)生了新的影響,為部分承認(rèn)與執(zhí)行此類判決提供了方法論基礎(chǔ)。建議我國(guó)法院在今后的司法實(shí)踐中采用分割方法承認(rèn)與執(zhí)行判決中與實(shí)際損失相符部分,對(duì)超出實(shí)際損失部分可以按比例承認(rèn)與執(zhí)行。
[Abstract]:The attitude of countries to recognize and enforce foreign punitive damages is different, mainly because of their dispute over the specific amount of punitive damages. Some countries recognize and enforce all punitive damages judgments. With the self-improvement of the punitive damages system, the application of the principle of proportionality and division has had a new impact on the standard of compensation. It provides a methodological basis for the partial recognition and enforcement of such judgments. It is suggested that the Chinese courts adopt the split method to recognize and enforce the judgment in accordance with the actual loss in the future judicial practice. The portion exceeding the actual loss may be recognized and enforced proportionately.
