【摘要】：海上鉆井平臺(tái)保險(xiǎn)是海上石油開發(fā)保險(xiǎn)中財(cái)產(chǎn)險(xiǎn)的一種,承保專門的保險(xiǎn)標(biāo)的。隨著我國(guó)海洋經(jīng)濟(jì)的興起,海上石油工業(yè)越來(lái)越受到重視,并日益成為我國(guó)重要的能源來(lái)源。但由于其技術(shù)復(fù)雜、投資高、風(fēng)險(xiǎn)巨大,所以石油開發(fā)的利害關(guān)系人必須通過(guò)專門的保險(xiǎn)轉(zhuǎn)嫁風(fēng)險(xiǎn)。而鉆井平臺(tái),作為海上石油工業(yè)發(fā)展中必不可少的設(shè)備,費(fèi)用昂貴,一旦發(fā)生事故,損失巨大。因此,對(duì)于保險(xiǎn)合同雙方甚至是整個(gè)保險(xiǎn)市場(chǎng)來(lái)說(shuō),海上鉆井平臺(tái)保險(xiǎn)的條款,都是至關(guān)重要的。 本文采用比較法的方法,立足于海商法的相關(guān)理論,對(duì)倫敦鉆井平臺(tái)保險(xiǎn)標(biāo)準(zhǔn)格式條款以及我國(guó)“鉆井平臺(tái)一切險(xiǎn)”條款進(jìn)行全面系統(tǒng)的分析,找出兩者的不同,從而試圖針對(duì)我國(guó)有關(guān)條款規(guī)定的不足,提出修改意見(jiàn)。 第1章“海上鉆井平臺(tái)保險(xiǎn)的概述”介紹了海上石油開發(fā)保險(xiǎn)、海上鉆井平臺(tái)的種類,并重點(diǎn)介紹英國(guó)倫敦鉆井平臺(tái)保險(xiǎn)標(biāo)準(zhǔn)格式條款的產(chǎn)生和發(fā)展,以及我國(guó)PICC'‘鉆井平臺(tái)一切險(xiǎn)”和“鉆井船一切險(xiǎn),進(jìn)而論述保險(xiǎn)條款的實(shí)質(zhì)和作用。 第2章“海上鉆井平臺(tái)保險(xiǎn)合同的基本要素研究”,對(duì)海上鉆井平臺(tái)保險(xiǎn)合同中基本要素如保險(xiǎn)標(biāo)的、保險(xiǎn)利益、保險(xiǎn)價(jià)值等進(jìn)行分析。 第3章“海上鉆井平臺(tái)保險(xiǎn)的承保風(fēng)險(xiǎn)及除外責(zé)任范圍研究”,從三個(gè)方面,即承保范圍、除外責(zé)任和戰(zhàn)爭(zhēng)險(xiǎn)免責(zé)對(duì)我國(guó)PICC'‘鉆井平臺(tái)一切險(xiǎn)”相關(guān)格式條款進(jìn)行全面分析,重點(diǎn)探討我國(guó)PICC“鉆井平臺(tái)一切險(xiǎn)”與英國(guó)倫敦鉆井平臺(tái)保險(xiǎn)標(biāo)準(zhǔn)格式條款的不同,建議適度擴(kuò)大承保范圍。 第4章“海上鉆井平臺(tái)保險(xiǎn)賠償中的幾個(gè)重要問(wèn)題研究”基于海商法的相關(guān)原理并結(jié)合保險(xiǎn)市場(chǎng)的實(shí)踐操作,探討PICC'‘鉆井平臺(tái)一切險(xiǎn)”下的施救費(fèi)用、共同海損分?jǐn)�、救助費(fèi)用以及責(zé)任限制、推定全損以及共保條款,對(duì)相關(guān)內(nèi)容的修改提出意見(jiàn)。 第5章“海上鉆井平臺(tái)保險(xiǎn)的其他重要內(nèi)容”包括防井噴裝置保證條款和其他保險(xiǎn)中普遍存在的內(nèi)容,比如注銷、免責(zé)和放棄代位求償權(quán)以及爭(zhēng)議處理。通過(guò)對(duì)比分析,從而全面系統(tǒng)的了解和完善我國(guó)相關(guān)條款。
[Abstract]:Offshore drilling platform insurance is a kind of property insurance in offshore oil development insurance, which covers the subject matter of special insurance. With the rise of marine economy in China, offshore oil industry has been paid more and more attention and has become an important source of energy in China. However, because of its complex technology, high investment and huge risk, the stakeholders of oil development must pass on the risk through special insurance. Drilling platform, as an indispensable equipment in the development of offshore oil industry, is expensive, and once an accident occurs, the loss is huge. Therefore, for both sides of the insurance contract and even for the whole insurance market, the terms of offshore drilling platform insurance are very important. In this paper, based on the relevant theories of maritime law, this paper makes a comprehensive and systematic analysis of the standard format clauses of London drilling platform insurance and the "all risks of drilling platforms" clause in China, and finds out the differences between the two. Therefore, in view of the shortcomings of the relevant provisions of our country, this paper tries to put forward some suggestions for amendment. Chapter 1, "an overview of offshore drilling platform insurance", introduces the offshore oil development insurance, the types of offshore drilling platforms, and focuses on the emergence and development of the standard format provisions of the British London drilling platform insurance standard. As well as all risks of PICC'' drilling platform in China and all risks of drilling ship, and then discusses the essence and function of insurance clause. Chapter 2, "Research on the basic elements of offshore drilling platform insurance contract", analyzes the basic elements of offshore drilling platform insurance contract, such as insurance subject matter, insurable interest, insurance value and so on. Chapter 3, "Research on the underwriting risk and scope of excluding liability of Offshore drilling platform Insurance", makes a comprehensive analysis of the relevant format clauses of all risks of PICC'' drilling platform in China from three aspects, namely, the scope of underwriting, the exemption of liability and the exemption of war risk. This paper mainly discusses the difference between PICC "all risks of drilling rig" in China and the standard format clause of British London drilling platform insurance, and suggests that the coverage should be expanded moderately. Chapter 4, "Research on several important problems in Offshore drilling platform Insurance compensation", based on the relevant principles of maritime law and combined with the practical operation of the insurance market, discusses the rescue expenses under all risks of PICC'' drilling platform, and the general average allocation. Save expenses and limitation of liability, presumptive total loss and co-insurance clause, and put forward suggestions on the revision of related contents. Chapter 5, "other important contents of offshore drilling platform insurance", includes the guarantee clause of blowout prevention device and the common contents in other insurance, such as cancellation, exemption and waiver of subrogation and dispute settlement. Through comparative analysis, so as to comprehensively and systematically understand and improve the relevant provisions of our country.
