論海上人身傷害的民事責(zé)任

【摘要】:海上人身傷害的民事責(zé)任是侵權(quán)行為法和海商法的重要組成部分。民法學(xué)界對(duì)這一特殊的民事責(zé)任關(guān)注較少,而海商法以航運(yùn)為中心的理念使其在海上人身傷害民事責(zé)任方面具有局限性。筆者將研究的視角置于海上人身傷害的民事責(zé)任,以民法中人身傷害民事責(zé)任的理論為框架,結(jié)合海上人身傷害的特殊性,對(duì)海上人身傷害的民事責(zé)任進(jìn)行相對(duì)系統(tǒng)的分析。本文將從海上人身傷害的民事責(zé)任的概念與特征、歸責(zé)原則、責(zé)任競(jìng)合以及責(zé)任范圍等四個(gè)方面展開(kāi)探討。在討論的過(guò)程中考慮并分析了國(guó)際公約和我國(guó)的法律現(xiàn)狀,最后對(duì)我國(guó)海上人身傷害的法律制度的完善提出了幾點(diǎn)改進(jìn)的建議。 第一章首先,討論了海上人身傷害的概念,認(rèn)為海上人身傷害,是指在海上或與海相通的可航水域或與其他與海密切相關(guān)的特定處所經(jīng)營(yíng)、管理和服務(wù)活動(dòng)中發(fā)生的人身傷害和精神損害;同時(shí)對(duì)海上人身傷害的時(shí)空要件和實(shí)質(zhì)要件進(jìn)行了分析,認(rèn)為對(duì)于海上人身傷害的界定,比較全面的標(biāo)準(zhǔn)就是將形式要件與實(shí)質(zhì)要件相結(jié)合。其次,分析了海上人身傷害民事責(zé)任的一般特征以及其不同于一般的民事責(zé)任的特征,主要表現(xiàn)在,,責(zé)任主體的特殊性、責(zé)任承擔(dān)的不平衡性以及責(zé)任規(guī)制的國(guó)際性和強(qiáng)制性。再次,根據(jù)不同的標(biāo)準(zhǔn)對(duì)海上人身傷害的民事責(zé)任進(jìn)行了分類。 第二章以民法的相關(guān)原理為指導(dǎo),同時(shí)考慮到我國(guó)海商法律移植的特殊性,分析了海上人身傷害民事責(zé)任的歸責(zé)體系。從當(dāng)事人之間的法律關(guān)系的角度出發(fā),結(jié)合責(zé)任性質(zhì)闡述了海上人身傷害賠償責(zé)任的歸責(zé)原則。 第三章主要論述的是海上人身傷害的責(zé)任競(jìng)合問(wèn)題。我國(guó)民法領(lǐng)域是承認(rèn)責(zé)任競(jìng)合的,海商法對(duì)當(dāng)海事責(zé)任競(jìng)合的適用與民法有所不同。國(guó)際公約對(duì)責(zé)任競(jìng)采取了避免和回避的態(tài)度,我國(guó)的海商法既沒(méi)有借鑒公約中細(xì)分責(zé)任基礎(chǔ)、回避責(zé)任競(jìng)合的做法,也沒(méi)有創(chuàng)立特別的處理辦法,而是選擇了國(guó)內(nèi)民法的處理辦法,承認(rèn)競(jìng)合并予以限制。筆者認(rèn)為,這對(duì)海商法的國(guó)際統(tǒng)一有不利的影響。 第四章主要討論是海上人身傷害賠償責(zé)任的范圍。其中涉及賠償?shù)脑瓌t,責(zé)
[Abstract]:Civil liability for personal injury at sea is an important part of tort law and maritime law. The civil law circles pay little attention to this special civil liability, but the maritime law takes the shipping as the center idea makes it have the limitation in the maritime personal injury civil liability. The author puts the research perspective into the civil liability of personal injury at sea, taking the theory of civil liability of personal injury as the frame and combining the particularity of personal injury at sea, to analyze the civil liability of personal injury at sea relatively systematically. This paper discusses the concept and characteristics of civil liability for personal injury at sea, the principle of imputation, the concurrence of liability and the scope of liability. In the course of the discussion, the international conventions and the current legal situation of our country are considered and analyzed. At last, some suggestions for the improvement of the legal system of personal injury at sea in China are put forward. Chapter one first discusses the concept of personal injury at sea, and considers that personal injury at sea refers to the operation of personal injury at sea or in navigable waters connected with the sea or other specific premises closely related to the sea, Physical and mental injury occurring in management and service activities; At the same time, this paper analyzes the space-time elements and the essential elements of personal injury at sea, and thinks that the more comprehensive standard for the definition of personal injury at sea is to combine the formal elements with the substantive elements. Secondly, this paper analyzes the general characteristics of the civil liability for personal injury at sea and its characteristics different from the general civil liability, which is mainly manifested in the particularity of the subject of liability, the imbalance of liability burden and the international and mandatory regulation of liability. Thirdly, the civil liability of personal injury at sea is classified according to different standards. The second chapter, guided by the relevant principles of civil law and taking into account the particularity of China's maritime law transplantation, analyzes the civil liability system for personal injury at sea. From the angle of the legal relationship between the parties, this paper expounds the liability imputation principle of maritime personal injury compensation according to the nature of liability. The third chapter mainly discusses the liability concurrence of personal injury at sea. The concurrence of liability is recognized in the field of civil law in our country, and the application of maritime law to the concurrence of maritime liability is different from that of civil law. International conventions have adopted the attitude of avoidance and avoidance of liability competition, and China's maritime law neither draws lessons from the basis of subdivision of liability in the Convention, avoids the practice of concurrence of liability, nor creates a special approach to dealing with it.
