【摘要】：外貿(mào)代理制形成于我國(guó)外貿(mào)體制改革過(guò)程,自其產(chǎn)生后就形成了獨(dú)具特色的內(nèi)容,并受到行政法與民商法的調(diào)整。現(xiàn)行對(duì)外貿(mào)代理的行政管理模式影響了外貿(mào)代理的實(shí)際運(yùn)用,而法律規(guī)范間的不融合也導(dǎo)致外貿(mào)代理制產(chǎn)生一些理論與實(shí)踐的問(wèn)題。外貿(mào)代理制度的重構(gòu)模式,既需要滿足法律體系的內(nèi)在邏輯性要求,也需要滿足各方利益均衡的要求。
[Abstract]:The agency system of foreign trade was formed in the course of the reform of foreign trade system of our country. Since its emergence, it has formed a unique content and has been adjusted by administrative law and civil and commercial law. The current administrative mode of foreign trade agency affects the practical application of foreign trade agency, and the disunion of legal norms also leads to some problems in theory and practice of foreign trade agency system. The reconstruction mode of foreign trade agency system needs not only the inherent logical requirements of the legal system, but also the requirements of balancing the interests of all parties.
