【摘要】： 英國在海上保險市場有著重要的地位和影響，毋庸置疑，，我國的保險法律制度和保險實踐也受到英國的巨大影響。所以，本文通過對英國海上保險法中有關全損、特別是推定全損和委付的法律制度的系統(tǒng)分析，通過將其與我國海上保險法律和實踐中相關法律制度進行比較研究，達到對有關全損的法律問題有一個全面和深入的理解，著重指出我國的有關全損、特別是推定全損和委付制度的規(guī)定中存在的問題，最終對我國《海商法》中關于全損的法律規(guī)定提出修改建議。相信會有助于一些相關的保險合同糾紛的解決，有助于我國海上保險法律制度完善。
[Abstract]:Britain has an important position and influence in the marine insurance market. There is no doubt that China's insurance legal system and insurance practice are also greatly influenced by the United Kingdom. Therefore, this paper makes a systematic analysis of the total loss, especially the constructive total loss and abandonment, and compares it with the relevant legal systems in China's marine insurance law and practice. Reaching a comprehensive and in-depth understanding of the legal issues relating to total losses, and stressing the problems existing in the provisions of our country regarding total losses, in particular the system of presumption of total loss and abandonment, Finally, some suggestions are put forward to amend the law of total loss in Maritime Law of our country. It is believed that it will be helpful to resolve some related disputes of insurance contract and to perfect the legal system of marine insurance in China.
