【摘要】：法律是調(diào)整社會關(guān)系,維護社會穩(wěn)定的行為規(guī)范。改革開放以來,隨著經(jīng)濟、文化的迅猛發(fā)展、立法技術(shù)的提高,法律更是應(yīng)用到所有的社會活動中。隨著我國與世界各國的交流日益頻繁,為了解決交流中有關(guān)的法律問題,需要將大量的中國法律翻譯成外語,尤其是英語。但書被廣泛地應(yīng)用到我國法律法規(guī)中,尤其是民商法。本文的研究是以功能目的論為理論框架,探討但書的英譯文本。功能目的論的核心在于翻譯目的和譯文的功能,而目的和功能正是法律翻譯的依據(jù),它要求譯文在最大限度上達到并滿足譯文的預(yù)期功能。因此,作者引入功能目的論,結(jié)合民商法的具體實例,探討法律文本中但書的英譯。本文共有六章。第一章對研究背景、意義和目的做了簡單介紹。第二章回顧了中外法律翻譯的研究成果,介紹了目的論的發(fā)展歷程、基本觀點和目的論的原則。此外,還回顧了國內(nèi)但書的研究現(xiàn)狀。第三章主要對但書的基本知識做了回顧,如概念,形式,功能等。第四、五章是本文的重點。作者從目的論的角度分析了中華人民共和國民商法的英文譯本�；诖罅康挠⒆g文實例,作者指出了譯文中存在的不足,并對此提出了一些解決方法。第六章的結(jié)論部分,作者得出:目的論可以用來指導(dǎo)法律文本中但書的英譯,同時也能有效地解決但書翻譯中出現(xiàn)的問題。
[Abstract]:Law is the norm of behavior that adjusts social relations and maintains social stability. Since the reform and opening up, with the rapid development of economy and culture and the improvement of legislative technology, the law has been applied to all social activities. With the increasingly frequent exchanges between China and other countries in the world, a large number of Chinese laws need to be translated into foreign languages, especially English, in order to solve the related legal problems. However, the book is widely used in China's laws and regulations, especially civil and commercial law. Based on the functional Skopos theory, this paper discusses the English translation of the proviso. The core of the Skopos Theory is the translation purpose and the function of the translation, which is the basis of legal translation. It requires the translation to achieve and satisfy the expected function of the translation to the maximum extent. Therefore, the author introduces the functional Skopos theory and discusses the translation of the proviso in the legal texts with the concrete examples of civil and commercial law. There are six chapters in this paper. The first chapter introduces the background, significance and purpose of the research. Chapter two reviews the research results of legal translation at home and abroad, and introduces the development of Skopos theory, the basic viewpoints and the principles of Skopos theory. In addition, the research status of the domestic proviso is also reviewed. The third chapter reviews the basic knowledge of proviso, such as concept, form, function and so on. The fourth and fifth chapters are the emphases of this paper. The author analyzes the English translation of the Civil and Commercial Law of the people's Republic of China from the perspective of Skopos theory. Based on a large number of English translation examples, the author points out the shortcomings of the translation and puts forward some solutions. In chapter six, the author concludes that Skopos theory can be used to guide the English translation of proviso in legal texts and to solve the problems in proviso translation.
