【摘要】：電子認(rèn)證行業(yè),如今正以驚人的速度蓬勃發(fā)展,而電子認(rèn)證的相關(guān)立法卻略顯滯后。本文按照介紹電子認(rèn)證、提出問題、解決問題以及展望未來的思路對現(xiàn)存的電子認(rèn)證法律漏洞進(jìn)行了研究。 導(dǎo)論部分,介紹了研究的原因、意義以及世界各國的電子認(rèn)證立法狀況。因為本文解決問題的思路之一就是通過對比國外先進(jìn)立法,所以此處為第四部分做了鋪墊。 第一部分,主要介紹了什么是電子認(rèn)證、電子認(rèn)證的立法模式、認(rèn)證證書、電子認(rèn)證的意義和必要性等內(nèi)容。為后面將要提出的問題做一個鋪墊。 第二部分,主要介紹了電子認(rèn)證機(jī)構(gòu),因為法律是以人的行為為研究對象的。 第三部分,提出問題。本文只羅列了所要研究的幾個主要法律問題,并不涵蓋全部。主要有：法律責(zé)任問題、自建CA問題、交叉認(rèn)證問題。 第四部分,解決問題。本文解決問題的思路一是借鑒海商法,主要用于解決電子認(rèn)證法律責(zé)任問題；思路二是對比國外法律,主要有美國猶他州《數(shù)字簽名法》、新加坡電子認(rèn)證法,來解決我國的問題。 第五部分,展望未來。根據(jù)《電子認(rèn)證服務(wù)業(yè)“十二五”發(fā)展規(guī)劃》的有關(guān)內(nèi)容,預(yù)測了相關(guān)立法在未來的發(fā)展方向。
[Abstract]:The electronic certification industry is developing rapidly at an amazing speed, while the relevant legislation of electronic authentication is lagging behind. This paper studies the existing electronic authentication legal loopholes in accordance with the introduction of electronic authentication, problems, solutions and future ideas.
The introduction part introduces the reasons and significance of the research and the status of electronic certification legislation in the world. One of the ways to solve this problem is to make a paving for the fourth part by comparing the advanced foreign legislation.
In the first part, it mainly introduces what is the electronic authentication, the legislative mode of the electronic authentication, the certification certificate, the significance and the necessity of the electronic authentication, which will be a paving for the problems to be put forward.
The second part mainly introduces the electronic authentication mechanism, because the law is based on people's behavior as the research object.
The third part, put forward the question. This article only lists several main legal problems to be studied. It does not cover all the main problems: the legal responsibility, the self construction of CA, the cross certification problem.
The fourth part is to solve the problem. One is to solve the problem. One is to draw on the maritime law, mainly to solve the problem of the legal liability of electronic certification; the two is to compare the foreign laws, mainly include the digital signature law of Utah state of the United States, and the electronic certification law of Singapore to solve the problems of our country.
The fifth part, looking forward to the future. According to the electronic certification service industry "relevant content of 12th Five-Year" development plan >, predicts the relevant legislation in the future direction of development.
