【摘要】： 市場(chǎng)經(jīng)濟(jì)是通過市場(chǎng)機(jī)制配置資源的一種經(jīng)濟(jì)運(yùn)行方式。市場(chǎng)機(jī)制的有效運(yùn)行需要法律制度來維護(hù),即形成一種良好的市場(chǎng)運(yùn)行法律秩序。隨著我國市場(chǎng)化改革的深入,遇到了一些亟待解決的問題,這些問題已經(jīng)影響到我國正常的市場(chǎng)運(yùn)行秩序,需要完善相關(guān)法律制度來解決。因此,本文以“我國市場(chǎng)運(yùn)行法律秩序問題研究”為題,對(duì)市場(chǎng)運(yùn)行法律秩序中存在的問題進(jìn)行研究,以期對(duì)完善我國市場(chǎng)運(yùn)行法律秩序有所啟示。 市場(chǎng)運(yùn)行法律秩序主要是指通過法律制度來保障市場(chǎng)運(yùn)行,從而形成一種穩(wěn)定、良好的市場(chǎng)運(yùn)行秩序。構(gòu)建我國市場(chǎng)運(yùn)行法律秩序需要兩個(gè)條件:一是制定維護(hù)市場(chǎng)運(yùn)行的法律制度,二是市場(chǎng)主體對(duì)法律制度的遵守。本文主要從制定法律制度方面展開,運(yùn)用演繹歸納、比較分析等方法對(duì)此問題進(jìn)行研究。 本文正文包括五部分: 第一部分是市場(chǎng)運(yùn)行法律秩序的基本問題。該部分首先論述了市場(chǎng)運(yùn)行法律秩序的屬性及構(gòu)成條件,市場(chǎng)運(yùn)行法律秩序的屬性包括平等性、自由性、競(jìng)爭(zhēng)性和統(tǒng)一性。其次,從立法角度介紹了我國市場(chǎng)運(yùn)行法律秩序的歷史沿革,主要分為兩個(gè)階段,第一階段是構(gòu)建時(shí)期,從我國十四大確立市場(chǎng)經(jīng)濟(jì)體制改革到我國加入WTO,這一時(shí)期的立法有力推動(dòng)了我國市場(chǎng)化改革;第二階段是重構(gòu)時(shí)期,從我國加入WTO至今,由于加入WTO,這一時(shí)期我國的立法目標(biāo)也發(fā)生變化,一方面對(duì)大量法律法規(guī)進(jìn)行了修改,以適應(yīng)WTO的規(guī)則;另一方面,為適應(yīng)我國市場(chǎng)經(jīng)濟(jì)體制改革的需要,制定了物權(quán)法、反壟斷法等法律。第三,簡(jiǎn)要介紹了我國目前市場(chǎng)運(yùn)行法律秩序中存在的問題,即區(qū)域市場(chǎng)運(yùn)行法律秩序問題、中介組織的發(fā)展問題、法律制度在市場(chǎng)運(yùn)行法律秩序中的作用問題。 第二部分是我國區(qū)域市場(chǎng)運(yùn)行法律秩序問題分析。在大國經(jīng)濟(jì)發(fā)展中,區(qū)域經(jīng)濟(jì)發(fā)展不平衡是一種普遍存在的現(xiàn)象。目前,我國區(qū)域間經(jīng)濟(jì)發(fā)展的不平衡問題已經(jīng)影響到我國經(jīng)濟(jì)的整體發(fā)展,鑒于此,構(gòu)建區(qū)域市場(chǎng)運(yùn)行法律秩序意義重大。本部分首先論述了建立區(qū)域市場(chǎng)運(yùn)行秩序的必要性、社會(huì)基礎(chǔ)、經(jīng)濟(jì)基礎(chǔ):其次對(duì)經(jīng)濟(jì)法在構(gòu)建區(qū)域市場(chǎng)運(yùn)行法律秩序的作用進(jìn)行了分析,經(jīng)濟(jì)法具有平衡區(qū)域經(jīng)濟(jì)主體之間利益沖突的作用;最后介紹國外維護(hù)區(qū)域市場(chǎng)運(yùn)行秩序的經(jīng)驗(yàn),對(duì)構(gòu)建我國區(qū)域市場(chǎng)運(yùn)行法律秩序具有借鑒意義。 第三部分中介組織是我國市場(chǎng)運(yùn)行法律秩序中的重要主體。協(xié)調(diào)好政府與市場(chǎng)主體之間的關(guān)系是我國市場(chǎng)運(yùn)行法律秩序發(fā)展的關(guān)鍵。隨著市場(chǎng)化改革的深入,中介組織作為市場(chǎng)運(yùn)行法律秩序中的重要主體,在市場(chǎng)經(jīng)濟(jì)發(fā)展中發(fā)揮著重要作用,但中介組織在實(shí)踐中發(fā)展的問題一直沒有得到妥善解決,其法律定位問題也一直存在爭(zhēng)議。本文通過介紹我國中介組織的現(xiàn)狀及存在的問題,分析政府與中介組織的關(guān)系,對(duì)中介組織進(jìn)行了法律定位。 第四部分是法律制度在我國市場(chǎng)運(yùn)行法律秩序中的作用。本部分主要研究法律制度對(duì)于市場(chǎng)運(yùn)行法律秩序的作用。首先闡述了維護(hù)我國市場(chǎng)運(yùn)行秩序的法律制度體系。其次,按照公法和私法的分類,對(duì)法律制度在維護(hù)市場(chǎng)運(yùn)行法律秩序中的具體作用進(jìn)行分析。私法在維護(hù)市場(chǎng)運(yùn)行秩序中起基礎(chǔ)性作用,表現(xiàn)在民事主體法律制度確立了市場(chǎng)主體資格,物權(quán)法律制度是市場(chǎng)運(yùn)行的前提,契約法律制度維護(hù)市場(chǎng)運(yùn)行秩序,商法為市場(chǎng)經(jīng)濟(jì)運(yùn)行提供制度性支持。公法在維護(hù)市場(chǎng)運(yùn)行法律秩序中起保障性作用。 第五部分是完善我國市場(chǎng)運(yùn)行法律秩序的對(duì)策。針對(duì)本文中具體研究的問題,提出相應(yīng)對(duì)策。在完善我國區(qū)域市場(chǎng)運(yùn)行法律秩序方面,需要維護(hù)區(qū)域市場(chǎng)競(jìng)爭(zhēng)秩序、完善區(qū)域經(jīng)濟(jì)調(diào)控制度和制定區(qū)域經(jīng)濟(jì)法律制度;在中介組織方面,完善規(guī)范中介組織的相關(guān)法律制度;在法律制度維護(hù)市場(chǎng)運(yùn)行秩序方面,由于公法制度和私法制度單獨(dú)作用于市場(chǎng)經(jīng)濟(jì)時(shí),都具有局限性,為更好的維護(hù)市場(chǎng)運(yùn)行秩序,需要公法與私法相互協(xié)調(diào)共同作用。
[Abstract]:Market economy is a kind of economic operation mode to allocate resources through market mechanism . The effective operation of market mechanism requires legal system to maintain , that is , form a good market operation law order . With the deepening of our country ' s market reform , we have encountered some problems that need to be solved urgently .



The legal order of market operation mainly refers to the guarantee of market operation through legal system , so as to form a stable and good market operation order . Two conditions are needed to establish the legal order of market operation in our country . One is to establish the legal system for the maintenance of market operation , and secondly , the compliance of the market subject to the legal system . This article mainly develops the legal system , uses deduction induction , comparative analysis and other methods to study the problem .



The main body of this paper includes five parts :



The first part is the basic problem of the market running legal order . This part firstly discusses the attributes and composing conditions of the market running legal order , the attributes of the market running legal order include equality , freedom , competition and unity .



The second part is the analysis of the legal order of regional market operation in our country . At present , the imbalance of regional economic development is a common phenomenon . At present , the unbalanced problem of regional economic development in our country has affected the whole development of our country ' s economy .



The third part of the intermediary organization is the important subject in the law order of the market operation in our country . It is the key to coordinate the relationship between the government and the market subject . With the deepening of the market reform , the intermediary organization plays an important role in the development of the market economy , but the problem of the intermediary organization in practice has not been solved properly .



The fourth part is the role of the legal system in the legal order of the market operation of our country . This part mainly studies the legal system of the legal system to the market operation law order . Secondly , according to the classification of public law and private law , it analyzes the concrete function of the legal system in the maintenance market operation law order .



The fifth part is the countermeasure to perfect the legal order of market operation in our country . In order to perfect the law order of regional market operation in our country , it is necessary to safeguard regional market competition order , perfect regional economic regulation system and establish regional economic law system . In the aspect of intermediary organization , we should perfect the relevant legal system of regulating intermediary organizations . In order to maintain market operation order independently , the public law system and the private law system should play a role in the better maintenance of market operation order , and the need of public law and private law to coordinate with each other .
