論海上油污損害賠償

【摘要】:隨著全球航運(yùn)事業(yè)的迅猛發(fā)展,發(fā)生在海洋上的各類大小不一的船舶油類污染事故對(duì)海洋生態(tài)環(huán)境正造成越來越大的破壞。我國作為一個(gè)擁有豐富海洋資源的沿海大國,近年來船舶油類污染事故時(shí)有發(fā)生,,盡管國際上的《1969年國際油污損害民事責(zé)任公約》和《1971年設(shè)立國際油污損害賠償基金公約》已經(jīng)生效,明確提出對(duì)由于船舶溢出或排放油類造成污染而遭受損害的人員給予適當(dāng)?shù)馁r償;我國的《海洋環(huán)境保護(hù)法》、《防止船舶污染海域管理?xiàng)l例》和《海洋環(huán)境管理?xiàng)l例》等海洋環(huán)境保護(hù)法律體系也對(duì)船舶油類污染損害賠償問題都做出了明確的規(guī)定,但具體落實(shí)起來難度較大。本文試圖從分析目前我國船舶油類污染損害處理的現(xiàn)狀與存在的問題人手,提出建立油類污染損害賠償機(jī)制的迫切性與具體設(shè)想,以期為落實(shí)油污損害賠償、遏制船舶油污事故的發(fā)生和切實(shí)保護(hù)海洋生態(tài)環(huán)境發(fā)揮作用。 本文針對(duì)當(dāng)前我國沿海運(yùn)輸船舶油污損害賠償無專門立法的情況,分析了《1969國際油污損害民事責(zé)任公約》、《1971基金公約》、《海環(huán)法》、《海商法》等對(duì)沿海運(yùn)輸船舶油污損害賠償?shù)囊?guī)定,并在此基礎(chǔ)上對(duì)海上油污損害的涵義、海上油損的特點(diǎn)、海上油損責(zé)任、海上油損的賠償和我國現(xiàn)在應(yīng)采取的措施進(jìn)行了論述,得出的結(jié)論是我國應(yīng)當(dāng)參考美國等國家的油污損害賠償制度,建立油污損害賠償基金制度、船東油污責(zé)任限制制度以及強(qiáng)制保險(xiǎn)制度,并提出了探索性建議。
[Abstract]:With the rapid development of the global shipping industry, various kinds of marine oil pollution accidents in the ocean are causing more and more damage to the marine ecological environment. As a large coastal country with rich marine resources, China has experienced oil pollution accidents from time to time in recent years. Despite the entry into force of the International Convention on Civil liability for Oil pollution damage of 1969 and the Convention establishing the International Fund for compensation for Oil pollution damage of 1971, To make it clear that appropriate compensation should be paid to persons who have suffered damage as a result of pollution caused by the spill or discharge of oil from ships; The marine environment protection laws of China, the regulations on the Prevention of Marine pollution and the regulations on the Management of Marine Environment have also made clear provisions on the compensation for damage caused by marine oil pollution. But the concrete implementation is difficult. Based on the analysis of the present situation and existing problems of oil pollution damage treatment in China, this paper puts forward the urgency and concrete idea of establishing the compensation mechanism for oil pollution damage, in order to realize the compensation for oil pollution damage. Containment of oil pollution accidents and effective protection of marine ecological environment play a role. In view of the fact that there is no special legislation on the compensation for oil pollution damage caused by coastal transport ships in China, this paper analyzes the provisions of the 1969 International Convention on Civil liability for Oil pollution damage, the 1971 Fund Convention, the Sea Environment Law, the Maritime Law, and so on. On this basis, the meaning of oil pollution damage at sea, the characteristics of oil loss at sea, the liability for oil loss at sea, the compensation for oil damage at sea and the measures to be taken by our country are discussed. The conclusion is that our country should refer to the oil pollution compensation system of the United States and other countries, establish the oil pollution damage compensation fund system, the shipowner oil pollution liability limitation system and the compulsory insurance system, and put forward some exploratory suggestions.
