國(guó)際海上貨物運(yùn)輸合同收貨人相關(guān)法律問題研究

【摘要】:在海上貨物運(yùn)輸合同中,收貨人具有特殊的法律地位。相關(guān)的國(guó)際公約、我 國(guó)海商法及大多數(shù)的提單內(nèi)容和條款卻對(duì)收貨人的法律規(guī)定、約定不清晰、不系 統(tǒng)、不完整。本文嘗試對(duì)收貨人的涵義、收貨人與提單持有人的關(guān)系、收貨人對(duì) 承運(yùn)人權(quán)利義務(wù)的法理依據(jù)、收貨人權(quán)利義務(wù)的系統(tǒng)歸納、收貨人對(duì)承運(yùn)人的訴 權(quán)等問題進(jìn)行研究,并指出相關(guān)的國(guó)際公約和我國(guó)海商法應(yīng)完善對(duì)收貨人的立法, 以更好的保護(hù)收貨人的合法權(quán)益,減少理論的爭(zhēng)論和司法實(shí)踐的混亂。 在對(duì)上述問題研究的基礎(chǔ)上,本文也嘗試對(duì)我國(guó)海商法有關(guān)收貨人的立法提 出相關(guān)的修改建議,以供參考。 我國(guó)海商法有關(guān)收貨人的概念是廣義收貨人的概念,原則上,這沒有問題, 但在有關(guān)特別保護(hù)狹義收貨人利益的條款中,應(yīng)將托運(yùn)人作為收貨人的情況排除 在外,具體體現(xiàn)在海商法第78條的修改意見中;為明確收貨人與提單持有人的關(guān) 系,本文主張應(yīng)規(guī)定提單持有人的法律概念,以減少理論的爭(zhēng)論和統(tǒng)一實(shí)踐中的 作法;本文認(rèn)為,有關(guān)收貨人對(duì)承運(yùn)人的權(quán)利、義務(wù)來(lái)源于法律的明確規(guī)定,因 此,我國(guó)海商法應(yīng)增加有關(guān)收貨人對(duì)承運(yùn)人的提貨請(qǐng)求權(quán)、訴權(quán)的明確規(guī)定,并 增加有關(guān)貨物控制權(quán)的法律規(guī)定,以完善我國(guó)海商法有關(guān)收貨人的法律規(guī)定。
[Abstract]:In a contract for the carriage of goods by sea, the consignee has a special legal status. China's maritime law and most of the contents and terms of bills of lading are unclear as to the legal provisions of the consignee. The meaning of consignee, the relation between consignee and holder of bill of lading, the relation between consignee and holder of bill of lading, the relation between consignee and holder of bill of lading, The legal basis of the carrier's rights and obligations, the systematic summary of the consignee's rights and obligations, and the consignee's action against the carrier. And pointed out that the relevant international conventions and China's maritime law should improve the legislation on the consignee, In order to better protect the legal rights and interests of the consignee, reduce the theoretical debate and judicial practice confusion. On the basis of the study of the above problems, this paper also tries to propose the legislation of the consignee in China's maritime law. Give relevant suggestions for modification for reference. The concept of consignee in China's maritime law is the concept of a broad sense of consignee. In principle, this is no problem. However, in the article on special protection of the narrow interests of the consignee, the circumstances in which the shipper is the consignee should be excluded.
