【摘要】: 關(guān)于海上貨物運(yùn)輸中承運(yùn)人留置權(quán)的問(wèn)題,歷來(lái)是我國(guó)航運(yùn)界、司法界研究的熱門(mén)課題,原因是在目前國(guó)際公約缺少這方面的明確規(guī)定,國(guó)內(nèi)法律又有諸多矛盾之處的情況下,眾多學(xué)者關(guān)于這個(gè)問(wèn)題的理解自然仁者見(jiàn)仁、智者見(jiàn)智。為了能有助于對(duì)這一問(wèn)題的理解,本文從民法關(guān)于留置權(quán)的一般理論出發(fā),主要對(duì)海商法中承運(yùn)人留置權(quán)性質(zhì)、成立、行使、效力等方面進(jìn)行了較為全面的討論。 包括引言和結(jié)論,本文大致可以分為以下六大部分: 引言主要介紹了筆者實(shí)習(xí)期間所遇到的承運(yùn)人(船東)實(shí)施留置的實(shí)際情形,以及關(guān)于承運(yùn)人留置廣泛的爭(zhēng)議性,明確了本文研究的目的和研究方法。 第一章主要介紹有關(guān)留置權(quán)的一般概念、基本特征以及大陸法下和英美法下對(duì)留置權(quán)法律性質(zhì)的認(rèn)定,構(gòu)成要件和行使要件。 第二章則簡(jiǎn)要闡述我國(guó)法律體系之下有關(guān)留置權(quán)的一般法律規(guī)定。 第三章是本文的重點(diǎn),主要就海上貨物運(yùn)輸中承運(yùn)人留置權(quán)的法律性質(zhì)、成立要件、行使要件、效力、留置權(quán)關(guān)系中當(dāng)事人的權(quán)利義務(wù)、消滅等方方面面逐一展開(kāi)討論,并結(jié)合中、英兩國(guó)的法律和案例作了一些比較分析。 第四章主要討論了租船運(yùn)輸下有關(guān)船東、二船東為其租金或者運(yùn)費(fèi)行使留置時(shí)應(yīng)該注意的問(wèn)題。 結(jié)論則主要明確闡述了筆者對(duì)承運(yùn)人行使留置權(quán)的觀點(diǎn),即承運(yùn)人欲穩(wěn)妥地行使留置權(quán),除了在運(yùn)輸合同、租船合同中明確其留置權(quán)外,還需要在提單中注明其有權(quán)為了相關(guān)費(fèi)用去留置貨物,或者在提單中明確地并入了相應(yīng)的運(yùn)輸合同、租船合同中的留置權(quán)的條款。
[Abstract]:On the carrier in the carriage of goods by sea lien, China's shipping industry has always been a hot topic of research, the judiciary, the reason is that in the current international convention on the lack of clear provisions in this regard, the domestic laws and there are many contradictions in the circumstances, many scholars on this issue understand the nature of each one according to his lights to. Contribute to the understanding of this issue, this article from the civil law theory on the lien of the main carrier in the maritime lien nature, establishment, exercise, carried out a detailed discussion effect and so on.
Including the introduction and the conclusion, this paper can be divided into the following six parts:
The introduction mainly introduces the actual situation that the carrier (shipowner) has implemented the lien during the internship, and the widespread controversy about the carrier's lien, and clarifies the purpose and research method of this paper.
The first chapter mainly introduces the general concept and basic characteristics of lien, as well as the identification of the legal nature of lien, the elements and the essentials of exercising lien under the continental law and Anglo American law.
The second chapter gives a brief description of the general legal provisions on Lien under the legal system of China.
The third chapter is the focus of this article, the legal nature, the main carrier in the carriage of goods by sea lien established condition, exercise elements, effectiveness, lien right relationship in the rights and obligations of the parties, to eliminate other aspects discussed, and combined with the British law, and case made some comparative analysis.
The fourth chapter mainly discusses the problems that should be paid attention to when the shipowner is concerned about the shipowner and the two shipowner for its rent or freight.
The main conclusion is clearly explains the author's lien view of carrier, namely carrier to safely lien, except in the transportation contract, charter the lien, in the bill of lading also need to have the right to specify the related expenses to detain the goods, or in the bill of lading expressly incorporated into the contract transport corresponding, lien clause in the charter party.
