【摘要】：我國是航運(yùn)大國,航運(yùn)業(yè)在我國國民經(jīng)濟(jì)中占有重要地位,航運(yùn)業(yè)的發(fā)展對(duì)我國對(duì)外貿(mào)易的發(fā)展和國民經(jīng)濟(jì)的健康運(yùn)行有著重大影響。船員作為航運(yùn)業(yè)第一線的工作者,是船舶運(yùn)輸行業(yè)最主要的勞動(dòng)者,在航運(yùn)生產(chǎn)中起著至關(guān)重要的作用。船員作為特殊行業(yè)——航運(yùn)業(yè)的從業(yè)人員,屬于社會(huì)的特殊群體,其所從事的海上乘務(wù)勞動(dòng)在生產(chǎn)力、生產(chǎn)關(guān)系、生產(chǎn)過程及勞動(dòng)成果方面,具有明顯的區(qū)別于一般陸上勞動(dòng)的特點(diǎn)。因此,需要對(duì)船員的勞動(dòng)權(quán)益予以特殊保護(hù)。然而,長期以來,我國在船員勞動(dòng)權(quán)益保護(hù)方面存在諸多問題,未能實(shí)現(xiàn)對(duì)船員勞動(dòng)權(quán)益的特殊保護(hù)。究其原因,根本的在于對(duì)船員勞動(dòng)合同的法律性質(zhì)認(rèn)識(shí)不清晰,從而導(dǎo)致有關(guān)船員勞動(dòng)合同的法律制度不健全。本文旨在從理論上確定船員勞動(dòng)合同屬于社會(huì)法性質(zhì)的特別勞動(dòng)合同,為船員勞動(dòng)合同的立法和法律適用提供理論指導(dǎo),以切實(shí)維護(hù)船員的勞動(dòng)權(quán)益。在本文中,筆者首先結(jié)合我國《海商法》中的“船舶”概念,明確了船員勞動(dòng)合同一方主體——“船員”的概念；其次,通過分析比較的方法,從社會(huì)法的理念、原則與特征的角度,闡釋了勞動(dòng)合同的法律性質(zhì)；進(jìn)而結(jié)合勞務(wù)合同與勞動(dòng)合同的關(guān)系,對(duì)船員勞動(dòng)合同的法律性質(zhì)進(jìn)行重點(diǎn)闡釋；最后筆者論證了實(shí)踐中名為“船員勞務(wù)合同”與“船員勞務(wù)外派合同”的法律性質(zhì)仍然屬于船員勞動(dòng)合同。從而確定了船員勞動(dòng)合同的特別勞動(dòng)合同的法律性質(zhì),以期能對(duì)船員給予特殊的勞動(dòng)法律保護(hù)提供必要的理論基礎(chǔ)。
[Abstract]:China is a big shipping country, and shipping industry plays an important role in our national economy. The development of shipping industry has a great influence on the development of foreign trade and the healthy operation of national economy. Crew is the most important laborer in the shipping industry, and plays a vital role in shipping production. As a special industry, the crew members belong to a special group of society, and the crew members are engaged in the marine crew work in the productive forces. The relations of production, the process of production and the outcome of labor are obviously different from those of ordinary land labor. Therefore, special protection of the labor rights and interests of crew members is needed. However, for a long time, There are many problems in the protection of crew's labor rights and interests in our country, and the special protection of crew's labor rights and interests has not been realized. The fundamental reason lies in the lack of clear understanding of the legal nature of the crew's labor contract. The purpose of this paper is to determine theoretically that the crew labor contract is a special labor contract of the nature of social law, and to provide theoretical guidance for the legislation and legal application of the crew labor contract. In order to protect the labor rights and interests of crew members, the author firstly defines the concept of "crew" as the main body of the crew labor contract by combining the concept of "ship" in Maritime Law of China, and secondly, by means of analysis and comparison, the author makes clear the concept of "crew member" as the main body of the crew labor contract. From the point of view of the concept, principle and characteristics of social law, this paper explains the legal nature of labor contract, and then, combining the relationship between labor contract and labor contract, explains emphatically the legal nature of the labor contract of crew. In the end, the author proves that the legal nature of the special labor contract of the crew member is still the crew labor contract, which is called "the crew labor contract" and "the crew labor assignment contract" in practice, and the legal nature of the special labor contract of the crew labor contract is determined. In order to give special labor legal protection to the crew to provide the necessary theoretical basis.
