【摘要】：正人身關(guān)系解決存在問(wèn)題,財(cái)產(chǎn)關(guān)系解決擁有問(wèn)題,只有先存在才能后擁有,這是自然的語(yǔ)法和邏輯。堅(jiān)持"人前物后",在《民法通則》中將人身權(quán)規(guī)定于物權(quán)之前,是完全的體系重構(gòu),而對(duì)于屬于德國(guó)法族的中國(guó)民法學(xué)和立法來(lái)說(shuō),應(yīng)該是一場(chǎng)革命。眾所周知,1986年的《民法通則》第2條對(duì)于民法的對(duì)象采用"物前人后"的表述,即把財(cái)產(chǎn)關(guān)系作為民法的首要對(duì)象,人身關(guān)系作為次要對(duì)象。2001年及以后,筆者開(kāi)始批判這樣的表述,其理路是:人身關(guān)系解決存在(to be)問(wèn)題,財(cái)
[Abstract]:It is natural grammar and logic to solve the existing problems in the positive personal relationship and the property relationship to solve the ownership problem. Insisting on "before and after things" is a complete systematic reconstruction of the right of person before the real right in the General principles of Civil Law, and it should be a revolution for the Chinese civil law and legislation belonging to the German French nationality. As we all know, Article 2 of the General principles of Civil Law in 1986 adopted the expression of "before and after things" for the object of civil law, that is, the property relationship as the primary object of civil law and the personal relationship as the secondary object.
