【摘要】：隨著現(xiàn)代社會對土地資源需求的不斷增大,特別是城市化的高速發(fā)展和科技水平的進步的刺激之下,各類地下空間設施如同雨后春筍一般涌現(xiàn)出來,為人們生產(chǎn)生活帶來巨大效益的同時,圍繞地下空間資源利用所產(chǎn)生的權(quán)屬糾紛問題日益突出,對傳統(tǒng)民法理論中關于土地所有權(quán)絕對化制度帶來了挑戰(zhàn)。從我國的現(xiàn)實情況來看,由于理論研究水平不足,特別是空間權(quán)制度立法工作上存在效力位階低,適用范圍有限,立法主體分散,內(nèi)容雜亂缺乏系統(tǒng)性等問題,地下空間權(quán)制度的主要內(nèi)容,譬如地下空間權(quán)屬關系,權(quán)利性質(zhì),權(quán)利處分方式,以及相應的程序規(guī)范都缺乏明確而完整的規(guī)定。本文通過對我國地下空間權(quán)進行初步的理論分析,借鑒國外立法狀況和國內(nèi)的立法模式,對我國地下空間權(quán)制度的立法構(gòu)建進行探究。本文內(nèi)容分成四部分。第一部分是從確立對地下空間權(quán)的基本認識出發(fā),為地下空間權(quán)做出基本定義,并從理論上闡述地下空間權(quán)作為一項新型的獨立權(quán)利納入物權(quán)法調(diào)整范圍的理論依據(jù)。第二部分主要對我國當前地下空間權(quán)立法規(guī)制現(xiàn)狀和問題進行描述和分析,并由此指出完善物權(quán)法律體系,制定統(tǒng)一的地下空間權(quán)法律制度是我國地下空間立法的必然方向。第三部分是借鑒境外立法模式,特別是以美國為代表的英美法系與德國日本為代表的大陸法系,以及臺灣為代表的綜合立法模式,并結(jié)合我國實際情況闡述了我國的地下空間權(quán)的立法模式設計上應作為物權(quán)法中的一項單獨用益物權(quán)加以規(guī)定。第四部分是為我國構(gòu)建地下空間權(quán)制度提供立法建議,從立法原則,法律關系,權(quán)利內(nèi)容以及權(quán)利變動制度幾個方面對空間權(quán)制度進行全面思考。
[Abstract]:With the increasing demand for land resources in modern society, especially under the stimulation of the rapid development of urbanization and the progress of science and technology, all kinds of underground space facilities have sprung up like bamboo shoots after a spring rain, which brings great benefits to people's production and life, at the same time, the problem of ownership disputes around the utilization of underground space resources is becoming more and more prominent. It challenges the absolute system of land ownership in the traditional civil law theory. From the reality of our country, due to the lack of theoretical research level, especially the lack of clear and complete provisions on the legislative work of the space right system, such as the low order of effectiveness, the limited scope of application, the dispersion of the legislative subject and the lack of systematicness of the contents, the main contents of the underground space right system, such as the ownership relationship of the underground space, the nature of the right, the way of disposition of the right, and the corresponding procedural norms, are lack of clear and complete provisions. Through the preliminary theoretical analysis of the underground space right in our country, this paper probes into the legislative construction of the underground space right system in our country by drawing lessons from the foreign legislative situation and the domestic legislative model. The content of this paper is divided into four parts. The first part is to make the basic definition of the underground space right from the establishment of the basic understanding of the underground space right, and theoretically expounds the theoretical basis that the underground space right as a new type of independent right into the scope of property law adjustment. The second part mainly describes and analyzes the current situation and problems of the legislative regulation of underground space rights in our country, and points out that perfecting the legal system of real rights and formulating a unified legal system of underground space rights is the inevitable direction of underground space legislation in our country. The third part is to draw lessons from the overseas legislative model, especially the common law system represented by the United States and the civil law system represented by Germany and Japan, as well as the comprehensive legislative model represented by Taiwan, and combined with the actual situation of our country, this paper expounds that the design of the legislative model of underground space right in our country should be stipulated as a separate usufruct in property law. The fourth part is to provide legislative suggestions for the construction of underground space right system in our country, and to think about the space right system from the aspects of legislative principle, legal relationship, right content and right change system.
