【摘要】：我國關(guān)于醫(yī)藥、生物技術(shù)領(lǐng)域不可專利客體的規(guī)定與《歐洲專利公約》第53條如出一轍。然而,近些年來,歐洲專利局通過狹義解釋第53條,極大限縮了該條款的適用范圍,這是歐洲為了發(fā)展經(jīng)濟(jì),在綜合考慮社會(huì)和經(jīng)濟(jì)因素后作出的理智選擇。通過詳細(xì)分析歐洲專利局的具體做法、動(dòng)因及結(jié)果,認(rèn)為,在我國域內(nèi)創(chuàng)新活躍的領(lǐng)域,也應(yīng)狹義解釋不可專利客體,發(fā)揮專利法本應(yīng)具有的功能。
[Abstract]:The regulation of non-patentable object in medicine and biotechnology in China is the same as Article 53 of European Patent Convention. In recent years, however, the European Patent Office has narrowed its scope of application by interpreting Article 53 in a narrow sense, which is a rational choice made by Europe in order to develop its economy after considering social and economic factors. Based on the detailed analysis of the specific practices, causes and results of the European Patent Office, it is considered that the non-patented object should also be interpreted in a narrow sense in the field of active innovation in our country, and the functions that the patent law should have should be brought into play.
