【摘要】：近年來(lái)我國(guó)互聯(lián)網(wǎng)技術(shù)和設(shè)施發(fā)展迅速,信息流通更加快捷,一方面在增進(jìn)網(wǎng)絡(luò)傳播信息便捷性的同時(shí),網(wǎng)絡(luò)逐漸成為了新聞傳播的重要載體,另一方面是助推了公民權(quán)利意識(shí)的覺(jué)醒。信息流轉(zhuǎn)速度迫使新聞媒體以更快的速度跟進(jìn),時(shí)效的要求導(dǎo)致有的新聞媒體為了追求利益縮短或者放松甚至忽略信息發(fā)布的審查環(huán)節(jié),導(dǎo)致越來(lái)越多的新聞媒體侵犯公民名譽(yù)權(quán)案件的發(fā)生。筆者從公民名譽(yù)權(quán)及新聞媒體自由權(quán)的概念入手,分析新聞媒體侵犯公民名譽(yù)權(quán)的類(lèi)型、構(gòu)成要件、抗辯事由,并結(jié)合國(guó)內(nèi)外法律提出解決新聞媒體侵犯公民名譽(yù)權(quán)案件的建議。本文分為五個(gè)部分。第一部分對(duì)新聞自由與公民名譽(yù)權(quán)的分開(kāi)闡述,作為分析該類(lèi)侵權(quán)案件成因的法理基礎(chǔ);第二部分詳細(xì)討論新聞媒體侵犯公民名譽(yù)權(quán)的構(gòu)成要件,包括:侵權(quán)行為、侵害后果、主觀(guān)過(guò)錯(cuò)、行為與結(jié)果有因果關(guān)系;第三部分詳細(xì)討論了新聞媒體侵犯公民名譽(yù)權(quán)的主要抗辯事由,包括:公正評(píng)論、受害人同意、可信的消息來(lái)源、正當(dāng)?shù)男惺箼?quán)力;第四部分,通過(guò)考察國(guó)外法律對(duì)名譽(yù)權(quán)的保護(hù)現(xiàn)狀,建議在立法上引入回應(yīng)權(quán)的概念;第五部分是建議通過(guò)完善新聞媒體侵犯名譽(yù)權(quán)的公眾人物概念、回應(yīng)權(quán)和精神損害賠償?shù)确矫?從立法角度提出新聞媒體侵犯公民名譽(yù)權(quán)的法律建議。
[Abstract]:In recent years, China's Internet technology and facilities have developed rapidly, and the flow of information has become more rapid. On the one hand, the Internet has become an important carrier of news dissemination while improving the convenience of network communication information. On the other hand, it promotes the awakening of citizen's right consciousness. The speed of information flow forces the news media to follow up at a faster rate. The requirement of prescription causes some news media to shorten or even relax or even ignore the censors of information release in order to pursue benefits. This has led to more and more cases of news media infringing upon citizens' right of reputation. Starting with the concept of citizen's right of reputation and freedom of news media, the author analyzes the types, elements and reasons of the news media infringing upon the right of citizen's reputation. And combined with domestic and foreign laws to solve the news media infringement of citizens' right of reputation case recommendations. This paper is divided into five parts. The first part of the freedom of the press and the right to reputation of citizens separately elaborated as the legal basis for the analysis of the causes of this kind of tort cases; The second part discusses the constitution of news media infringing on citizen's right of reputation in detail, including: tort, consequence of infringement, subjective fault, causality between act and result; The third part discusses in detail the main reasons of news media infringement of citizens' right of reputation, including: fair comments, victims' consent, credible sources of information, legitimate exercise of power; The fourth part, by investigating the current situation of the protection of the right of reputation in foreign laws, it is suggested that the concept of the right of response should be introduced into the legislation. The fifth part is to put forward the legal suggestions of news media infringing on citizens' reputation from the angle of legislation by perfecting the concept of public figures, the right of response and the compensation for spiritual damage, which are infringed by the news media.
