【摘要】：本案系上海市首起因侵犯國(guó)際標(biāo)準(zhǔn)文件著作權(quán)而被公訴的刑事案件,并被國(guó)家版權(quán)局列為"2014劍網(wǎng)"行動(dòng)重點(diǎn)案件。該案中,法院認(rèn)定ISO、IEC國(guó)際標(biāo)準(zhǔn)文件屬于我國(guó)法律保護(hù)的作品,被告人王某通過(guò)網(wǎng)絡(luò)銷售盜版ISO、IEC國(guó)際標(biāo)準(zhǔn)文件的行為系《刑法》第二百一十七條所指的"復(fù)制發(fā)行"行為,并根據(jù)案件實(shí)際情況,基于刑事謙抑原則,只將從被告人處查獲的部分侵權(quán)ISO、IEC國(guó)際標(biāo)準(zhǔn)文件計(jì)入被告人侵犯著作權(quán)犯罪的數(shù)量。
[Abstract]:This case is the first criminal case in Shanghai for infringing the copyright of international standard documents and listed by the State copyright Administration as a key case of action of "2014 Sword net". In this case, the court found that the ISO,IEC international standard documents belong to the works protected by Chinese law, and the defendant Wang Mou sold pirated ISO, through the network. The behavior of the IEC international standard document is the act of "reproduction and distribution" referred to in Article 217 of the Criminal Law. According to the actual situation of the case, and based on the principle of criminal modesty, only part of the tort ISO, seized from the defendant will be seized. The IEC international standard documents account for the number of copyright infringements committed by the accused.
