【摘要】：期待權(quán)相對于傳統(tǒng)民事權(quán)利類型,從理論上可以說是一種處于取得物權(quán)途中的新型權(quán)利。它活生生地存在于社會生活,當權(quán)利的取得在時間或效力上具有了不同的程度,就可能產(chǎn)生期待權(quán)。為了保障期待利益不受減損并順利轉(zhuǎn)化成完整權(quán)利,法律賦予期待權(quán)保障和防御的效力,可對抗相對人、任意第三人的妨害行為。期待權(quán)因受到法律的完備保護而具有預先效力,獲得權(quán)利取得的確定性和獨立的可讓與性。
[Abstract]:Compared with the traditional type of civil rights, the right of expectation can be said to be a new type of right in the process of obtaining real right. It exists alive in social life. When the right is acquired in different degree in time or effect, it may produce the right of expectation. In order to ensure that the expected interest is not diminished and transformed into a complete right, the law gives the right of expectation protection and defense, which can resist the nuisance of the relative person and any third party. Due to the complete protection of the law, the right of expectation has pre-effect and acquires the certainty and independence transferability of the right.
