【摘要】：正引言筆者之前處理過(guò)這樣一起網(wǎng)絡(luò)攝影作品侵權(quán)糾紛案件:原告甲是一家專門做攝影作品知識(shí)產(chǎn)權(quán)代理的公司,其于2014年5月31日通過(guò)與案外人乙簽訂《版權(quán)轉(zhuǎn)讓合同》獲得了涉案攝影作品著作權(quán)法項(xiàng)下可轉(zhuǎn)讓的所有權(quán)利,合同約定,對(duì)于轉(zhuǎn)讓前以乙名義已經(jīng)開(kāi)展的訴訟維權(quán)事務(wù)則由乙履行至案件終結(jié);合同生效后,甲可以以自己的名義進(jìn)行維權(quán),所得收益歸屬甲。后甲針對(duì)被告丙在2010年未經(jīng)授權(quán)擅自上線使
[Abstract]:The author has dealt with a case of infringement of online photography works: plaintiff A is a company specializing in the intellectual property rights of photographic works.
