論電子游戲畫面“實質(zhì)性相似”的判斷標準

【摘要】:許多電子游戲畫面由于自身具備獨創(chuàng)性可以構(gòu)成以類似攝制電影方法創(chuàng)作的作品,因而可以獲得著作權(quán)法的保護。在對涉案電子游戲畫面是否構(gòu)成"實質(zhì)性相似"判定時,可以借鑒"抽象—過濾—比較"的方法將電子游戲畫面中的表達提取出來并一一比對,從而做出是否侵權(quán)的認定。
[Abstract]:Many video games can be protected by copyright law because of their originality. When judging whether the picture involved in the video game constitutes "substantial similarity", we can draw lessons from the method of "abstract-filter-comparison" to extract and compare the expressions in the picture of the video game, so as to determine whether the infringement is infringed or not.
