【摘要】：為使預告登記制度良性運作,我國《物權法》第20條第1款第2句所謂"處分"應包括民事執(zhí)行措施。預告登記得排除強制處分,法釋[2015]10號提出的"先查封后解除"方案,與《協(xié)助執(zhí)行若干問題的通知》第15條第1項的價值判斷相沖突,其正當性與可行性尚無確證。事實上,在預告登記義務人為被執(zhí)行人的情形下,法院可借鑒輪候查封制度來處理預告登記與查封登記的銜接問題,即法院可依債權人的申請對已預告登記的房屋進行輪候查封。當預告登記權利人為被執(zhí)行人時,依《協(xié)助執(zhí)行若干問題的通知》第15條第3項,法院可依債權人的申請,"預查封被執(zhí)行人購買的辦理了商品房預告登記的房屋"。此處所謂"預查封"措施,應定性為對被執(zhí)行人房屋給付請求權的扣押。我國應當借鑒德國法,盡快完善被執(zhí)行人給付請求權執(zhí)行制度。
[Abstract]:In order to make the notice registration system work well, the second sentence of the first paragraph of Article 20 of our country's "property Law" should include civil execution measures. Notice registration may exclude compulsory punishment, and the scheme of "first seal and then release" put forward by law interpretation [2015] 10 conflicts with the value judgment of item 1 of Article 15 of "Notification to assist in the implementation of certain problems", and its legitimacy and feasibility have not been confirmed. In fact, when the obligor of notice registration is the executor, the court may refer to the waiting for closure system to deal with the connection between notice registration and seal registration. The court may, upon application by the creditor, queue for closure of a house registered with notice. When the owner of notice registration right is the executor, according to the third item of Article 15 of "notice to assist in the execution of some problems", the court may, on the application of the creditor, "pre-seal the house that the executor has purchased to deal with the notice registration of commercial housing". The so-called "pre-sequestration" measures should be characterized as the sequestration of the right to claim for payment of the house under execution. Our country should draw lessons from the German law and improve the execution system of the executor's right of claim as soon as possible.
