【摘要】：《藥物臨床試驗質(zhì)量管理規(guī)范》規(guī)定申辦者應(yīng)對參加臨床試驗的受試者提供保險,對于發(fā)生與試驗相關(guān)的損害或死亡的受試者承擔(dān)治療的費用及相應(yīng)的經(jīng)濟補償。從4個藥物臨床試驗賠償案例證明:如果申辦者不破產(chǎn),責(zé)任保險對醫(yī)療機構(gòu)和受試者實際價值不明顯。如果申辦者破產(chǎn)或者申辦者不在國內(nèi),責(zé)任保險是保障醫(yī)療機構(gòu)足額賠償受試者后能夠獲得保險公司賠償。因此,責(zé)任保險賠償限額應(yīng)當(dāng)根據(jù)《侵權(quán)責(zé)任法》確定。
[Abstract]:The quality Management Standard of Drug Clinical trial stipulates that the applicant shall provide insurance for the subjects participating in the clinical trial, and bear the cost of treatment and the corresponding economic compensation for the subjects who have suffered the injury or death associated with the trial. It is proved from the cases of four drug clinical trials that if the applicant does not go bankrupt, the actual value of liability insurance to medical institutions and subjects is not obvious. If the applicant goes bankrupt or the applicant is out of the country, the liability insurance is to ensure that the medical institution can obtain the insurance company's compensation after paying full compensation to the subjects. Therefore, liability insurance compensation limits should be determined according to the Tort liability Law.
