【摘要】：共同錯誤是指在締約過程中雙方當事人對于與締約相關(guān)的特定事項具有相同的不準確認識。鑒于在自始履行不能等情況下所發(fā)生的錯誤通常為共同錯誤,并且在計算錯誤等情況下共同錯誤比單方錯誤更易于引發(fā)救濟,有必要在法理上對其加以探討。共同錯誤能否引發(fā)救濟的關(guān)鍵在于因錯誤而遭受不利影響的一方是否承擔了發(fā)生錯誤的風險。在無從根據(jù)當事人的意思分配風險時,可斟酌合同的利益交換格局、合同的特性等因素加以判斷。影響風險分配的諸要素應(yīng)結(jié)合不同的案型予以具體化。
[Abstract]:Common error means that both parties have the same inaccurate understanding of specific matters related to contracting in the process of contracting. In view of the fact that the errors that occur under the condition that the performance cannot be performed from the beginning are usually common mistakes, and common errors in the case of calculation errors are more likely to cause relief than unilateral errors, it is necessary to discuss them in legal theory. The key to whether common error can lead to remedy lies in whether the party who is adversely affected by the mistake bears the risk of error. When there is no way to distribute risks according to the parties' wishes, we can judge the benefit exchange pattern of the contract, the characteristics of the contract and so on. The factors affecting risk distribution should be concretized in combination with different case types.
