【摘要】：人格權(quán)受"憲法"及民事法之保障,在結(jié)構(gòu)上呈現(xiàn)封閉與開(kāi)放之系統(tǒng),在功能上分別表現(xiàn)為規(guī)制國(guó)家對(duì)于人格權(quán)之限制的框架,以及規(guī)范人格權(quán)受侵害時(shí)之民事上的救濟(jì)。在法社會(huì)學(xué)之法的確信與法律學(xué)與法實(shí)務(wù)之法釋義學(xué)上,向來(lái)根深蒂固取向于精神上利益。通過(guò)制定法的不斷修訂與法官造法,人格權(quán)的發(fā)展趨于完善。但仍存有尚未盡善之憾,當(dāng)有規(guī)范需要時(shí),必須藉助于法律補(bǔ)充,尋求其該當(dāng)之規(guī)范。
[Abstract]:The personality right is protected by the Constitution and civil law, and presents a closed and open system in structure. In function, it is shown as the frame of regulating the restriction of personality right by the state, and the civil relief when the personality right is violated. In the conviction of law in sociology of law and in the interpretation of law in law and practice, it has always been deeply rooted in spiritual interests. The development of personality right tends to perfect through the revision of the law and the law of judge. However, there is not yet perfect regret, when the need for regulation, must be supplemented by the law to seek its proper norms.
