【摘要】：我國(guó)于2013年10月通過了修改后的《消費(fèi)者權(quán)益保護(hù)法》,即"新消法",新消法于2014年3月15日正式實(shí)施。隨著《消費(fèi)者權(quán)益保護(hù)法》的修改,其他關(guān)于網(wǎng)購(gòu)權(quán)益保護(hù)的法規(guī)及管理辦法也相繼出臺(tái),此舉進(jìn)一步體現(xiàn)了我國(guó)對(duì)網(wǎng)絡(luò)消費(fèi)權(quán)益保護(hù)的日益重視。新消法對(duì)網(wǎng)購(gòu)中消費(fèi)者的知情權(quán),隱私權(quán)以及求償權(quán)保護(hù)進(jìn)行改進(jìn),同時(shí)針對(duì)網(wǎng)購(gòu)格式條款作出規(guī)定,確定了消費(fèi)者的后悔權(quán),進(jìn)一步保證了網(wǎng)購(gòu)消費(fèi)者權(quán)利的實(shí)現(xiàn)。但是,新修改的《消費(fèi)者權(quán)益保護(hù)法》對(duì)于網(wǎng)絡(luò)消費(fèi)者權(quán)益保護(hù)并非絕對(duì)完善,仍存在漏洞和需要細(xì)化的地方。本文主要論述新消法對(duì)網(wǎng)購(gòu)消費(fèi)者的相關(guān)權(quán)利保護(hù)做出的改進(jìn)以及對(duì)消費(fèi)者權(quán)利保護(hù)存在的漏洞,文章最后淺談個(gè)人建議。
[Abstract]:China passed the revised Consumer Rights and interests Protection Law in October, 2013, that is, the New Law on Consumer Rights and interests, which was formally implemented on March 15, 2014. With the revision of the Consumer Rights and interests Protection Law, other laws and regulations on the protection of online shopping rights and interests have been issued one after another, which further reflects the increasing importance that our country attaches to the protection of network consumption rights and interests. The new law improves consumers' right to know, right to privacy and the protection of their right to claim in online shopping. At the same time, it stipulates the terms of online shopping format, determines consumers' right of regret, and further ensures the realization of consumers' rights. However, the newly revised Law on Protection of Consumer Rights and interests is not absolutely perfect for the protection of consumers' rights and interests on the Internet, and there are still loopholes and areas that need to be refined. This paper mainly discusses the improvement of the new law on the protection of consumers' rights and the loopholes in the protection of consumers' rights. At the end of the article, the author discusses the personal suggestions.
