【摘要】：煙草危害是當今世界最為嚴重的公共衛(wèi)生問題之一。法律對公共衛(wèi)生的直接調整,面臨著個人自由、公眾健康以及國家利益的沖突和博弈。通過侵權法實現法律對公共衛(wèi)生的間接調整,是協(xié)調這一沖突的重要路徑。然而,在煙草侵權訴訟中,因果關系之證成、賠償范圍之劃定均面臨困難,加之被告經常提出責任免除或減輕的抗辯,其實踐效果差強人意。在現有法律調整不足的背景下,充分發(fā)揮訴訟外救濟的功能,是適當填補受害人損失,進而間接增進公共健康的有效路徑。
[Abstract]:Tobacco harm is one of the most serious public health problems in the world. The direct adjustment of law to public health is confronted with conflicts and games of individual freedom, public health and national interests. The indirect adjustment of law to public health through tort law is an important way to coordinate this conflict. However, in the tobacco tort lawsuit, the evidence of causality and the demarcation of the compensation scope are all faced with difficulties. In addition, the defendant often raises the defense of exemption or mitigation of responsibility, and its practical effect is unsatisfactory. Under the background of insufficient adjustment of the existing law, it is an effective way to make full use of the function of extra-litigation relief to fill the loss of the victim and indirectly improve public health.
