【摘要】：在中國《物權(quán)法》采納物權(quán)法定原則的大背景下,各地展開的農(nóng)地抵押探索活動,實質(zhì)上是一種漸進式"試錯"行為。農(nóng)地抵押地方"試錯"行為與法治建設(shè)并不相悖,這是其存在的正當性依據(jù),而農(nóng)地財產(chǎn)功能的挖掘、農(nóng)村內(nèi)生金融之構(gòu)建,也呼吁該種"試錯"行為出現(xiàn)。農(nóng)地抵押地方"試錯"行為并非沒有局限,需要在"試錯"的主體、程序、期限等方面受到限制。在具體的農(nóng)地抵押地方"試錯"行為中,應扭轉(zhuǎn)對財政的過分倚重,適度放開農(nóng)地抵押參與主體,通過完善農(nóng)村產(chǎn)權(quán)交易市場,充分挖掘農(nóng)地財產(chǎn)功能,推動農(nóng)地抵押實質(zhì)性進展。
[Abstract]:Against the background of the adoption of the principle of real right law in China, the exploration of agricultural land mortgage carried out in various places is in essence a gradual "trial and error" behavior. The behavior of "trial and error" of farmland mortgage is not contrary to the construction of rule of law, which is the legitimate basis of its existence. However, the excavation of the function of farmland property and the construction of rural endogenous finance also call for this kind of "trial and error" behavior to appear. The behavior of "trial and error" in farmland mortgage area is not without limitation, it needs to be restricted in the subject, procedure and time limit of "trial and error". In the concrete "trial and error" behavior of farmland mortgage, the excessive reliance on finance should be reversed, the participation subject of farmland mortgage should be loosened moderately, and the function of farmland property should be fully excavated by perfecting the market of rural property right transaction. Promote the substantial progress of farmland mortgage.
