全版權(quán)運(yùn)營(yíng)下作品多重改編問題研究

【摘要】:隨著移動(dòng)互聯(lián)網(wǎng)技術(shù)的進(jìn)步和泛娛樂化產(chǎn)業(yè)的發(fā)展,圍繞作品的經(jīng)濟(jì)利益開發(fā)而逐漸形成了全版權(quán)運(yùn)營(yíng)模式。在全版權(quán)運(yùn)營(yíng)模式下,為盡可能地挖掘版權(quán)價(jià)值,一個(gè)作品通常被改編成多種形式,并且隨著改編作品的成功,對(duì)改編作品的版權(quán)價(jià)值挖掘也隨之展開,于是出現(xiàn)了對(duì)已改編作品的再次改編,從而出現(xiàn)對(duì)作品進(jìn)行多重改編的情形。根據(jù)現(xiàn)行《著作權(quán)法》的規(guī)定,改編作品的著作權(quán)由改編者享有,但與此同時(shí)改編作品又受到《著作權(quán)法》第十二條的限制。對(duì)改編作品進(jìn)行再改編可能引起原作品方、原改編作品方、原作品授權(quán)方和改編作品授權(quán)方的權(quán)利及利益沖突,造成多方法律糾紛。全版權(quán)運(yùn)營(yíng)下作品運(yùn)營(yíng)主體都積極的參與其中主動(dòng)地對(duì)作品進(jìn)行發(fā)射性的推廣,使作品改編呈現(xiàn)出改編內(nèi)容多元化和改編被許可主體多元化的特點(diǎn),通過對(duì)全版權(quán)運(yùn)營(yíng)下由作品多重改編所致糾紛的典型案例分析,作品多重改編產(chǎn)生糾紛多是源于改編作品授權(quán)范圍不明確和各方著作權(quán)主體權(quán)利沖突所致,而導(dǎo)致糾紛發(fā)生的根本原因則是因?yàn)楝F(xiàn)行法律對(duì)改編作品的權(quán)利行使界定模糊,以及作為市場(chǎng)交易客體的改編權(quán)本身的財(cái)產(chǎn)權(quán)利屬性涉及到作品多重改編各方主體的市場(chǎng)利益平衡。從法律對(duì)改編作品的相關(guān)規(guī)定和作品的市場(chǎng)價(jià)值角度出發(fā)進(jìn)行研究,以利益平衡為理論基礎(chǔ)構(gòu)建合理的作品多重改編的利益分配規(guī)則。作品多重改編的利益分配應(yīng)當(dāng)考慮各方創(chuàng)作者的利益平衡以及創(chuàng)作者與作品使用者的利益平衡,由于作品使用者包括社會(huì)公眾,即還應(yīng)當(dāng)考慮公共利益的平衡。除了在進(jìn)行改編權(quán)授權(quán)時(shí)通過合同約定各方的利益分配,對(duì)作品多重改編的授權(quán)還可以類比適用著作權(quán)法中法定許可的方式,以實(shí)現(xiàn)一定程度上各方主體的利益平衡。結(jié)合對(duì)作品多重改編所致糾紛現(xiàn)狀及其根本原因的分析,和對(duì)作品多重改編情形下利益平衡的分析,提出對(duì)于《著作權(quán)法》相關(guān)制度的改進(jìn)建議,明確改編作品的著作權(quán)行使,應(yīng)當(dāng)對(duì)《著作權(quán)法》第十二條中“不得侵犯原作品著作權(quán)”的進(jìn)行合理解釋,“不得侵犯原作品著作權(quán)”應(yīng)當(dāng)解釋為改編作品的權(quán)利行使受到不得損害原作品著作權(quán)人權(quán)益的制約。通過區(qū)分改編作品與原作品的獨(dú)創(chuàng)性表達(dá)部分,合理地規(guī)制改編作品著作權(quán)財(cái)產(chǎn)權(quán)利行使的授權(quán),在不侵犯原作品著作權(quán)的前提下,實(shí)現(xiàn)原作品與改編作品市場(chǎng)利益獲得的雙贏。
[Abstract]:With the progress of mobile Internet technology and the development of pan-entertainment industry, the whole copyright operation mode is gradually formed around the development of economic benefits of works. In the whole copyright operation mode, in order to excavate the copyright value as much as possible, a work is usually adapted into many forms, and with the success of the adapted work, the mining of the copyright value of the adapted work is also carried out. Then there appeared the re-adaptation of the adapted works, which resulted in multiple adaptations of the works. According to the current copyright Law, the copyright of the adapted work is enjoyed by the editor, but at the same time, the adaptation of the work is restricted by Article 12 of the copyright Law. Readaptation of the adapted works may cause conflicts of rights and interests between the original work parties, the original adaptation works parties, the original work licensees and the adaptation works licensees, resulting in various legal disputes. Under the whole copyright operation, the main body of the operation of the work is actively involved in the active promotion of the work, which makes the adaptation of the work present the characteristics of the diversification of the adaptation content and the diversification of the subject of the adaptation of the license. Through the analysis of typical cases of disputes caused by multiple adaptations of works under the whole copyright operation, it is found that the disputes arising from multiple adaptations of works are mostly caused by the unclear scope of authorizations of the adapted works and the conflict of the rights of the copyright subject of various parties. The root cause of the dispute is the vague definition of the exercise of the right to work adaptation in the current law. As the object of market transaction, the property rights attribute of the adaptation rights involves the balance of the market interests of the parties involved in the multiple adaptations of the works. From the angle of the relevant regulations of the law and the market value of the adapted works, this paper constructs the reasonable rules of interest distribution of the multiple adaptations of the works on the basis of the theory of balance of interests. The interests distribution of multiple adaptations of works should consider the balance of the interests of the creators and the interests of the creator and the users of the works, because the users of the works include the public, that is, the balance of the public interests should also be considered. In addition to the distribution of the interests of the parties stipulated in the contract, the authorization for multiple adaptations of works can also be analogous to the way of applying the statutory permission in copyright law, in order to achieve the balance of the interests of the parties to a certain extent. Based on the analysis of the present situation and the root causes of the disputes caused by the multiple adaptation of works, and the analysis of the balance of interests under the situation of multiple adaptation of the works, the author puts forward some suggestions for the improvement of the relevant system of the copyright Law, and clarifies the copyright exercise of the adapted works. "No infringement of the copyright of the original work" shall be reasonably interpreted in Article 12 of the copyright Law, "the copyright of the original work shall not be infringed" shall be interpreted as that the exercise of the right to adapt the work shall be restricted by the rights and interests of the copyright owner of the original work. By distinguishing the original expression part between the adapted work and the original work, the author reasonably regulates the authorization of the exercise of the property right of the copyright of the adapted work, without infringing upon the copyright of the original work, To achieve the original works and the adaptation of the market interests of the win-win.
