【摘要】：網(wǎng)絡(luò)奇才谷阿莫?jiǎng)?chuàng)作的"X分鐘帶你看完電影"系列受到追捧,但被影視公司指責(zé)侵犯著作權(quán)。在美國判例法下戲仿作品具有模仿和評論原作品的特征,該系列符合戲仿作品的定義。就中國法院的實(shí)踐來看,該系列涉嫌侵犯改編權(quán),且在采用主觀主義的情況下涉嫌侵犯保護(hù)作品完整權(quán)。因?yàn)閼蚍伦髌返奶厥庑?合理使用原則需要進(jìn)行相應(yīng)調(diào)整。較高的轉(zhuǎn)換性使用程度允許該系列具有商業(yè)目的,對原作品的使用沒有超過喚起受眾對于原作品的記憶的程度,該系列對于原作品的市場也沒有造成不利影響,但對改編作品的潛在市場的影響存在疑問。
[Abstract]:Internet Wizards Gu Amor's "X minute to take you through the movies" series is popular, but has been accused of copyright infringement by film and television companies. Parody works have the characteristics of imitating and commenting on the original works under American case law, and the series accords with the definition of parody works. According to the practice of Chinese courts, the series is suspected of violating the right to adaptation and the right to protect the integrity of works under the condition of subjectivism. Because of the particularity of parody works, the principle of rational use needs to be adjusted accordingly. The high degree of transformational use allows the series to have commercial purposes, the use of the original works is not greater than the recall of the original works by the audience, and the series does not have a negative impact on the market for the original works, But there are questions about the potential market for the adaptation.
