【摘要】：本文以馬克思主義基本原理作為指導(dǎo),以農(nóng)民工作為研究對象,以農(nóng)民工權(quán)益的法律保障為主線,以構(gòu)建和完善社會主義和諧社會作為落腳點(diǎn),深入的分析了農(nóng)民工權(quán)益的法律保障的迫切性與必要性,客觀闡述了農(nóng)民工權(quán)益保障的重要性,從我國現(xiàn)有的法律制度與農(nóng)民工自身方面解析了農(nóng)民工權(quán)益的法律保障與和諧社會的關(guān)系。從我國的實(shí)際情況為出發(fā)點(diǎn),以馬克思主義基本原理為指導(dǎo),理論聯(lián)系實(shí)際,系統(tǒng)分析當(dāng)前我國對農(nóng)民工權(quán)益保障的發(fā)展情況。本文分為三部分：一、對農(nóng)民工權(quán)益保障的理論闡述。這部分是研究本文的前提和基礎(chǔ),也是解析農(nóng)民工權(quán)益法律保障的指導(dǎo)方法。本文以我國農(nóng)民工權(quán)益保障的現(xiàn)狀及農(nóng)民工生存狀況為背景,以馬克思主義雇工權(quán)益保護(hù)理論、馬克思主義人權(quán)觀和我國的法治理論為指導(dǎo)方法,剖析我國農(nóng)民工權(quán)益的法律保障與和諧社會的關(guān)系。二、本部分分析了當(dāng)前我國農(nóng)民工權(quán)益保障的現(xiàn)狀及原因,主要針對當(dāng)前我國農(nóng)民工權(quán)益保障的現(xiàn)狀及存在的問題。主要從農(nóng)民工的經(jīng)濟(jì)權(quán)利、社會保障、政治權(quán)利、文化教育權(quán)利四個(gè)方面展現(xiàn)當(dāng)前我國對農(nóng)民工法律權(quán)益保護(hù)方面存在的問題,橫向上針對我國對農(nóng)民工法律權(quán)益保護(hù)的傳統(tǒng)體制、社會環(huán)境、政策環(huán)境、法律制度、和農(nóng)民工自身的五個(gè)因素方面分析對農(nóng)民工法律權(quán)益保護(hù)的影響。三、對農(nóng)民工權(quán)益保障提供相關(guān)解決措施,這部分是本文研究的核心部分,分別從立法、行政執(zhí)法和構(gòu)建農(nóng)民工權(quán)益保障體制三大方面進(jìn)行系統(tǒng)闡述,對農(nóng)民工權(quán)益的保障提供具體針對性解決措施。本文通過對農(nóng)民工權(quán)益保障的研究,依據(jù)提出問題、分析問題、解決問題的思路,以馬克思主義基本原理作為指導(dǎo),對我國農(nóng)民工權(quán)益的保障提出了幾項(xiàng)針對性對策,對我國農(nóng)民工的合法權(quán)益在法律和制度方面給予保障,讓農(nóng)民工更好的參與到我國城市化與現(xiàn)代化的建設(shè)進(jìn)程中來,有利于維護(hù)社會的長治久安,促進(jìn)我國的社會主義和諧社會建設(shè)進(jìn)程,確保我國全面建設(shè)小康社會的目標(biāo)如期完成。
[Abstract]:This paper takes the basic principles of Marxism as the guidance, migrant workers as the research object, the legal protection of the rights and interests of migrant workers as the main line, and the construction and improvement of a harmonious socialist society as the foothold. It deeply analyzes the urgency and necessity of the legal protection of the rights and interests of migrant workers, and objectively expounds the importance of the protection of the rights and interests of migrant workers. This paper analyzes the relationship between the legal protection of the rights and interests of migrant workers and the harmonious society from the aspects of the existing legal system and migrant workers themselves. From the point of view of the actual situation of our country, guided by the basic principles of Marxism, this paper systematically analyzes the development of the protection of the rights and interests of migrant workers in our country at present under the guidance of integrating theory with practice. This article is divided into three parts: first, the protection of migrant workers rights and interests of the theoretical elaboration. This part is the premise and foundation of the study, and is also the guiding method to analyze the legal protection of the rights and interests of migrant workers. This paper takes the present situation of the protection of migrant workers' rights and interests in our country as the background, the Marxist theory of protection of the rights and interests of hired workers, the Marxist view of human rights and the theory of the rule of law in our country as the guiding method. This paper analyzes the relationship between the legal protection of the rights and interests of migrant workers and the harmonious society. Second, this part analyzes the current situation and reasons of the protection of the rights and interests of migrant workers in China, mainly in view of the current situation and problems of the protection of the rights and interests of migrant workers in China. Mainly from the four aspects of economic rights, social security, political rights, cultural and educational rights of migrant workers, it shows the problems existing in the protection of the legal rights and interests of migrant workers in our country. In view of the traditional system, the social environment, the policy environment, the legal system, and the five factors of the protection of the legal rights and interests of the migrant workers in China, this paper analyzes the influence on the protection of the legal rights and interests of the migrant workers horizontally. Third, to provide relevant solutions to the protection of the rights and interests of migrant workers, this part is the core part of this study, respectively from the legislation, administrative law enforcement and the construction of migrant workers' rights and interests protection system three major aspects of systematic elaboration. Protection of the rights and interests of migrant workers to provide specific targeted solutions. Based on the research on the protection of the rights and interests of migrant workers, this paper puts forward several targeted countermeasures for the protection of the rights and interests of migrant workers in China under the guidance of the basic principles of Marxism and the train of thought of raising, analyzing and solving the problems. The legal rights and interests of migrant workers in our country are guaranteed in terms of laws and systems, so that migrant workers can better participate in the process of urbanization and modernization in our country, which is conducive to maintaining the long-term stability of society. To promote the process of building a harmonious socialist society in China and to ensure that the goal of building a well-off society in an all-round way is completed as scheduled.
